Show Sixth District Court Actions Judge David Mower heard several court cases on Oct. 1 in Sixth District Court. David Lamb, 22, . Panguitch, appeared for sentencing. He was charged with arranging to distribute a controlled substance, a 3rd degree felony. He was ordered to serve 30 days in jail, at 48-hour intervals before Jan. 31, 1999 and to keep at least one full-time job. He was also ordered to pay $1,500 in fines at $100 a month, starting Nov. 1, attend substance abuse counseling, submit to searches when asked, and was given 24 months probation. Judge Mower reserved jurisdiction, stating that if Lamb did everything right during his probation, his sentence would be dropped to a misdemeanor from the felony charge. Joseph Daniel Rushing, 34, of California, formerly of Panguitch, was in court to answer charges of theft by deception, a 3rd degree felony. Rushing allegedly obtained control over property, $12,000, from David and Laura Andreas, on Aug. 15 in Garfield County. The charges alleged that Rushing was to have built a home for the Andreases and didn't finish the job, then canceled payment on the reimbursement check he made out to the Andreases. He was picked up on a warrant in California and ordered to appear in Panguitch. A plea bargain is in the works between Rushing, his attorney, Keith Barnes, Cedar City, and prosecuting attorney Wallace Lee. Rushing did plead guilty to the charge and was ordered to undergo a pre-sentence report. The case was continued until Jan. 7. Ronnie Davenport, 24, of Panguitch, was picked up in Cedar City on an outstanding warrant and (See COURT on page 5-A) COURT (From Front Page) brought back to Panguitch to see Judge Mower to answer to charges of violation of his probation. Davenport pleaded guilty to four of the six charges against him. He agreed that he left the state of Utah without permission from his probation officer, that he tested positive to using marijuana during probation, that he did not complete substance abuse counseling, and that he consumed alcohol on Sept. 23. The case was continued until Nov. 12. |
