Project means the completion and furnishing of the improvements as defined in the DESCRIPTION OF IMPROVEMENTS hereinafter set forth. Assessment" means a special tax levied against property within the proposed Special Improvement District to pay all or a portion of the costs of making assessments in the District Block" means a numbered block within a plat of the total boundaries of the Duchesne City Survey. Bond" or Special Improvement Bonds" means bonds issued payable from assessments, improvement revenues or from the Special Improvement Guaranty Fund or Reserve Fund. Code means Utah Code Annotated, 1953, as amended, as of date of this Resolution or as it may be amended at any time during the existence of the District. Contract Price means the amount payable to one or more contractors for de- fined. 1 7A-3-3- Property Representative means an owner of property and each parcel of Property (as Parcel is defined herein) can, for purposes of any matter affecting the District, have only one Property Representative. BOUNDARIES AND IMPROVEMENTS GENERALLY It is die intention of die de- scribed in the foregoing paragraph. AREA AND BASIS FOR ASSESSMENT Respecting and pertaining to the property within the District, the property owners will be assessed for Improvements built at the hereinbelow estimated rales and for the abutters portion ofcertainmiscellaneous costs ofthe Project according to the following rates: ( 1 ) There will be one rate and one rate only. (2) Assessments shall be made upon ;thc basis of acreage or square footage with possible exceptions or modifications where appropriate based upon considerations which may arise in the final design and construction of the improvements. (3) For purposes of computing necessary protests for defeating the District, the calculations shall be based upon acreage orsquare foot- BASIS FOR ASSESS- MENT The assessments shall be made according to acreage or square footage. A map of die District and the rate for assessments are available for review in theCityRecordersOffice, South 165 Center, Duchesne, Utah. Also available isalistofall property owners affected and the rate schedule for each. All other necessary things shall be done to complete the whole project according to plans, profiles and specifications on file in the office of the City Recorder. All nonconforming improvements such as lawns, sprinkling systems, rock gardens, driveways, curbs and gutters, culverts, walks, fences, ebx, which have been built or installed by abut- ting property owners within the area to be improved, must be removed by the property owners at their expense prior toowners, they will be removed by the contractor and disposed of by him as directed by the Engineer. ESTIMATED COST OF IMPROVEMENTS The total cost of Improvements (excluding Extras) in the proposed Spe- -. cial Improvement District as estimated by the Engineer is $674,225 (only $378,735 of which will be paid by the District) and which shall be paid by a special tax to be levied upon the property and particularly the land to be improved by the Project as defined, llie actual commitment of the District to pay its portion of the costs of Improvements is subject to the availability offunds and compliance with budget approval. The estimated property owner's costs include a reasonable allowance for construction contingencies and an allowance of approximately fifteen percent of the base amount (15) to be assessed for administrative, legal, and other costs in connection with the assessments, the issuance of bonds and bond interest, except that interest may be abated by prepayment as explained hereafter. The property owners' portion of the total estimated costs of the improvements may be financed during the construction period by the use of interim warrants. The interest on the warrants will be included in the costs to be assessed to the property owners. The estimated cost to be assessed against the properties within the District shall be as follows: ESTIMATED INDIVIDUAL COSTS A Assessments. The Protest Rate for determining the necessary number of protests to require abandonment of the District or an Area of the District (Protest Rate) shall be determined by totaling the acreage of property in ownership of persons filing written protests and if fifty (50) per cent or more of the acreage is represented by owners filing protests, then the proposed District or Area within the District shall be abandoned.
