Show Decision by Supreme Court 3-- 2 6 Utah Receive Awards In Speech Contest Action by Police Warrants New Trial Court Rules for Convicted Car Thief By Paul Roily Tribune Staff Writer A convicted auto thief should get a new trial on his conviction of a second car theft because police illegally opened the car door to read the vehicle identification number without a against unreasonable search and seizure because a police officer entered his car and searched for evidence against him without getting a warrant from a judge The actual theft of the Mustang occurred in 1981 when a man asked to test drive the car from Utah Auto Sales and never returned it Shortly after that incident Larocco was convicted of stealing a truck and was sent to the Utah State Prison He dropped the Mustang off at a relative's house where it was stored until be was released from prison in 1985 About that time the salesman at Utah Auto Sales spotted Ltdocco in another automobile show room and notified police that he was the man who stole the Mustang four years warrant That is the conclusion of the Utah Supreme Court which in a split de- cision released this week reversed the auto-theand convictions of Phillip Paul Larocco Larocco who spent three years in prison from 1982 to 1985 for stealing a truck was arrested after his release in 1985 for the 1981 theft of a 1973 Ford Mustang from the State Auto Sales lot He was eventually convicted of that theft even though he was not a suspect in the theft until four years after it occurred and the Utah Court of Appeals upheld the conviction But the Supreme Court in a decision written by Justice Christine Durham concluded Larocco was denied his constitutional protection ft le possession-of-astolen-vehic- earlier Two Salt Lake City police officers went to Larocco's residence spotted the Mustang and looked through the window at the vehicle identification number which matched the number of the car of an owner Larocco said he had purchased the Mustang from 3-- 2 Museum Plans Summer Academy test The event which drew students from Hurricane to Logan was sponsored by Utah's credit unions and organized by the Utah Family Involvement Council and the Utah League of Credit Unions Contestants addressed the question: "The EducaReal or Imagined?" tion Crisis The League is the trade organization for Utah credit unions while the Council is an organization designed to promote family involvement throughout all levels of the credit union movement Holly Otto Lehi High School won the $2500 first-plac- e scholarship Bryce Larkin Hurricane High placed second winning a Tom Martin Uintah High School Vernal won third-plac- e and a $1000 scholarship Placing fourth and winning an $800 scholarship was Michelle Krelo Hillcrest High School Emma Dibble Layton High School won a MO scholarship and Ginger Wimmer Clearfield High School won a $600 scholarship School $1500 scholarship Park to study a broad range of natural history topics The cost is $205 The Utah Museum of Natural History is offering its Summer Field Science Academy as an enrichment program for children in the second-grad- e through high school Taught by teams of instructors with expertise in biology anthropology geology and ecology the short courses emphasize field observations experiments collecting and writing a journal of both scientific data and personal reactions to the natural world Registration is through the Muse581- um Education Department 4887 Some scholarships are available based on financial need Application deadline is May 1 The high school program will meet June 25-2in Yellowstone National Six Utah high school seniors have received scholarships worth a total of $7100 in the 4th annual Credit Union Oratorical Scholarship Con- But one officer then opened the car door and looked at the vehicle identification number on the door jam which was another number Subsequent investigation found that the Mustang Larocco said he had purchased was actually destroyed in an accident Larocco was arrested and convicted on that evidence But the Supreme Court said the officer should have gone to a judge and gotten a warrant before opening the car door Because obtaining that evidence was illegal under the Fourth Amendment of the US Constitution and Article I Section 14 of the Utah Constitution the court held that information should be excluded from the evidence brought against Larocco and it ordered a new trial Justice Richard Howe dissented in the opinion arguing that the purpose of requiring a vehicle identification number is defeated it an investigative officer cannot look at it to determine if a car had been stolen Chief Justice Gordon R Hall joined in Justice Howe's dissent Students counter for body care the way you've always wanted it to be Simple effective fast and luxurious bur best choices now are nine bio- 13-1- 5 fifth-grad- 18-2- ACM6 OK:r al -
