Show 5 Legislators File Suit Bandit Robs Bank of Housing Appropriation Illegal, Judge Decides The 42nd Legislature's passage of a $750,000 appropriation for low income housing was declared Ulegal Wednesday by 3rd District Court Judge David Winder. The decision comes from a suit filed by five legislators who said proper voting procedures in the final hours of the January session were not followed Gov. Scott M Matheson signed the K. Court to Sentence Former Officer For Misconduct A former Salt Lake City police officer who was found guilty of official misconduct will be sentenced for the crime Tuesday at 3 p.m. John C. Davis, 29, 4919 W. 3850 South, was found guilty in the court of City Judge Robert C. Gibson. He was also charged with theft but the jury found insufficient evidence to support that charge. The charges stem from an incident in the Salt Lake Jail in which $5 cash was stolen from a man being booked for public intoxication. It was recorded on a videotape camera scanning the entrance to the jail. Davis was fired several days following the incident. Also to be heard Tuesday will be a defense motion to dismiss the misconduct conviction. City-Coun- To Clarify Procedure Mr. Harrison said the suit was filed mainly to clarify the voting procedure used by the House of Representatives. "It is imperative that legislators be able to determine the status of a particular bill at all stages of the legislative process. "It is also important that the vote of each individual member of the legislature be recorded so that legislators remain responsive to their constituents, he said No Recorded Vote After the bill was amended in the Senate, there was no recorded vote taken in the House, he said. Most, if not all legislators were of the view that the bill had failed to pass the budget session. The bill was belatedly processed for signing by the speaker and the governor only after clerical personnel Mr. insisted that it had passed, Harrison said. He said the court's ruling "does not foreclose the expenditure of funds for low income housing. That same $750,000 will be available for appropriation by the legislature during the special session to be held in May, he said.
