Mr. Johansen said that the idea of giving local taxing entities additional taxing powers has been kicked around for some time, but this was the first time he has heard of such powers being given to a school district. Mr. Johansen brought the board up to date on the countys filing of a protest on the Tax Commissions order to refund tax money to UP&L. He said that the county filed its protest based on two objections: 1) There is no explanation from the Tax Commission regarding the reasons behind the settlement amount; and 2) the method of taxing utilities is unconstitutional. Mr. Johansen said that counties throughout the state are filing similar protests and that it is anticipated that one of the protests will become a test case which could end up in the Supreme Court. He said that the matter will be tied up for the next several months which should eliminate any cash flow worries the county or school district might have regarding repayment of the UP&L taxes. Dr. Weeks said that UP&L officials have contacted the school district seeking to set up a meeting with local officials. Mr. Johansen said that such a meeting would be helpful but that it should not take place before the Nov. 30 taxing deadline. Each year the Emery FHA chapter chooses a family in the community which is an example to all and represents the goals and purposes of FHA The family entertained ECHS student body with a variety of talent numbers and a video presentation. The program was coordinated by Maleah Day. Girls and boys basketball teams traveled to Cedar City to participate in a weekend tournament at Southern Utah State College.
