Orozco Varax, 28, also of Franklin, Idaho, may never be known. Dr. Serge Moore, Utah Medical Examiner, testified before the court that one bullet entered the brain and lodged under the skin, fracturing the skull upon entry and exit. As the trial began and attorneys presented their arguments in the case of Frank Joe Renteria, it became apparent as the three days came to a close, the jury would be unable to come to a conclusion and find Renteria guilty of criminal homicide. On Friday at 4 p.m. the foreman of the jury notified Frist District Judge Venoy Christoffersen the jury had reached a verdict. They deliberated about three hours. M. E. Gibbs, Harper Ward, member of the jury arose when the judge called for the verdict and said "we, the jury, find the defendant not guilty." Those close to the trial in the gallery took the verdict with a prejudicial expectation. The Renteria family sighed with relief and embraces followed the judge's instruction that the bail be lifted and Frank Joe Renteria was free to leave the court room. The witnesses called to the stand testified the barroom was dark and nearly impossible to see what had actually transpired. This continued point of "darkness in the bar" prevailed during the Renteria trial. This, coupled "with possof ible the defendants with other persons present in the room was to play an important part in the future for Balderas and Sanchez. During the Renteria trial, Balderas was called to testify and he accused Sanchez of firing the weapon. Victor Varax, the victim's cousin, testified in court through an interpreter, David Grimley, one bullet entered the right side of his mouth and the fragment remains lodged against the jugular vein on the right side of his neck. The second bullet struck and fractured his arm. According to witnesses who were in the Bomb Shelt- er shortly before 1 a.m. on September 19, arguments were common with some shoving and shouting at times. Dozens of witnesses and officers testifying before the jury said there were anywhere from 25 to monton ranch hand - in the bar at the time of the shooting - strongly voiced that it was Renteria who fired the gun. Renteria, himself, blamed Sanchez for the gunplay. When Sanchez was summoned to come before the court during the Renteria trial, he refused. Through his legal counsel, Sanchez refused to take the stand because of his constitutional rights.
