Huntsman snubs fed No Child Left Behind SALT LAKE ( T I Y (AP) Gov. Jon Huntsman Jr. planned to sign ;i measure Monday defying the federal No Child Lefl Behind Ael despite a warning from Education Secretary Margaret Spellings that il could cost $76 million in federal aid. Il represents the strongest stand against ihe federal law among \5 slates considering anti-No Child Left Behind legislation this year. I h e bill, passed during a special session of the Legislature last monlh. gives Utah's education standards priority over federal requirements of the No Child Lefl Behind Act. Il lets education officials ignore provisions of federal law that conflicts with the stale's program. Huntsman planned to sign the bill late Monday afternoon at an elementary school inside the legislative district of Rep. Margaret Dayton. R-Provo, who has been leading Ihe fight against what she calls Ihe unfunded mandates of President Bush's signature education law. Asked for comment. Huntsman referred questions to his education clcputy. Tun Bridgewaler, who said he doubled Utah's stance would cost it any money. "It empowers decision makers in the state education system, where (here is conflict wilh federal law. lo chtxtse lo follow the stale objective first," Bridgewaler s.iid MondayOnly schools serving low-income populations-about a third of Utah's - will have to wrestle over stale and federal standards. They can satisfy both standards - "it's really splitting hairs." Bridgewater said. Utah plans to obey benchmark No Child requirements, like reporting schools' annual yearly progress toward a goal of having all students excel in reading and math for Iheir grade level, and informing parents when sch<x>ls fail lo measure up. When schools fail, parents can demand a tutor or send their children to better schools in the same district. Utah's preferred way of measuring student achievement is called UPASS. or ihe Utah Performance Assessment System for Students, which compares achievement as students progress from grade to grade. No Child Left Behind compares ihe grade-level test scores of students to the students in the same grade level from previous years. "They have not lei us completely replace the federal system with U-PASS." but negotiations are con- tinuing, Bridgewater said, Spellings' office didn't immediately return a call Monday from The Associated Press.
