II. 1989 Last publication Jan. 25, 1989 Issue No. 49 C-845 r WHEREAS, pursuant to the provisions provi-sions of Utah Law a procedure has ' been provided for municipalities to reclaim re-claim any unused lot, site, or portions of the cemetery which are unused for more than 60 years; and WHEREAS, the City Council of Farmihgton has directed the City ; Treasurer to survey and ascertain those lots that have remained unused for burial purposes for more than 60 years which survey has been com- Dieted; and . WHEREAS, the Farmingtdn City Council desires to give appropriate notice as required by law tothe owners of such lots; and - WHEREAS, the Farmington City Treasurer has been directed to reclaim any lots for which notice of claims have not been submitted following the required re-quired notice. NOW, THEREFORE. BE IT RESOLVED RE-SOLVED BY THE CITY COUNCIL OF FARMINGTON CITY. STATE OF UTAH: ; Section 1. Persons and-or owners of any lot, site or portion of the Farming-ton Farming-ton City Cemetery which has been unused un-used for burial purposes for more than 60 years are hereby required to file with the Farmington City Recorder a notice -of claim to such unused lot, she or parcel par-cel within the time provided herein. The notice of claim should state the individual's intention to use the lots for burial purposes. Section 2. The. Farmington City Treasurer is hereby directed to caywa copy of this Resolution to be persdiyly ' served upon the owner or person having hav-ing the right to burial within the City Cemetery on all lots that have not been used for burial purposes for at least 60 years provided that the Treasurer shall be able to ascertain the name and location loca-tion of such persons to provide personal person-al service. In the event the person having hav-ing the right to burial or owner cannot be personally served with this Resolution, Resolu-tion, the Farmington City Treasurer is hereby directed to cause the same to be published in a newspaper of general circulation cir-culation within Davis County, State of Utah, for a period of three consecutive-weeks. consecutive-weeks. This Resolution shall be published pub-lished in its entirety together with Exhibit Ex-hibit A which is attached hereto and by this reference is made a part hereof. The information contained in Exhibit A specifies the names of those persons having right to burial and-or owners and the lot numbers and grave information informa-tion pertaining to said individual's interest in-terest in the cemetery according to the records of the City. In addition, the Treasurer is further directed to publish this Resolution together with Exhibit A attached nere to once per week in the Salt Lake Tribune, Deseret News, and the Ogden Standard Examiner and in the Farmington Newsletter to be published pub-lished in the month of January 1989. Section 3. After personal service and-or and-or publication of this Resolution, the owner or any person with a legal interest in-terest in the cemetery lots fails to state a valid interest in the use of the cemetery cemet-ery lot for burial purposes, the owner or person's rights shall be deemed terminated ter-minated and that portion of the cemet-. cemet-. ery shall be automatically Vested in Farmington City. For purposes of this Resolution the filing deadline for notice of interest shall be 60 days after personal person-al service upon an individual Or 60 day s after the date of last publication in the Davis County Clipper. Section 4. Upon vesting of any unused un-used lots, sites or parcels in Farming-ton Farming-ton City, the City shall thereafter have the right to sell said lots in accordance with the rules and regulations pertaining pertain-ing to the Farmington City Cemetery. Section 5. This Resolution shall become be-come effective immediately upon first publication in the Davis County - Clipper.
