Show Pust shooting justified CEDAR CITY - Iron County Attorney At-torney James L. Shumate has determined deter-mined that there is no criminal liability involved in the killing of a Roy man by a Cedar City police officer early March 1. James L. Pust, 18, fled from officers after robbing the Bingo Gas Station in Parowan at gunpoint earlier that morning. According to Shumate, the officer commanded the suspect to halt, saying "Freeze or I'll shoot." The suspect disregarded the officer's command and continued to run northwest nor-thwest in the New Castle area. The officer, armed with a 12-gauge shotgun fired one shot striking the suspect on the right rear of his neck and also on the suspect's right arm, according ac-cording to Shumate. The suspect was carrying a .22 caliber pistol in his left hand when he exited his vehicle, and was found approximately ap-proximately 142 feet northwest of the officer that fired the shot. When officers reached the suspect, he was found to be clutching the pistol and lying face down, unconscious, according ac-cording to Shumate. It was determined at a later date, by the State Medical Examiner's Office, that there were four gunshot pellet wounds on.Pust's body. |
