Show ONLY 9 PERCENT OF MINERS FILING CLAIMS WITH BLM More than 36,500 mining claims have been filed with the Bureau of Land Manage -ment's Utah state office for recordation as required by the Federal Land Policy and Management Act of 1976. According to Paul L. Howard, How-ard, BLM Utah State director, direc-tor, these claims probably account for about nine percent per-cent of the claims in the state estimated at between three and five hundred thousand thou-sand that must be filed with the BLM as a result of the new law. Howard said the law requires recordation of all unpatented mining claims on public lands. Failure to file constitutes abandonment of the claim. Those claims located lo-cated prior to passage of the Act on October 21, 1976, must be filed within three years of the date of the Act. Claims located after that date must be filed with BLM within 90 days after date of location. Most of those claims which have been filed fall into the category of claims located after Oct. 21, 1976. Owners of older claims are not filing fil-ing them. - Topaz Berillium has filed suit in federal court challenging chal-lenging the constitutionality of duplicate recordation of mining claims with the county recorder and BLM. |
