Show AN ORDINANCE GRANTING A FRANCHISE TO THE UTAH PARKS COMPANY BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS COMMIS-SIONERS OF THE COUNTY OF WASHINGTON, STATE OF UTAH: SECTION 1. That there is hereby here-by granted unto the Utah Parks Company, a corporation, its successors suc-cessors and assigns, the franchise and right to do a public business over the wires placed and installed by it, or by its predecessor, over, upon, along, or across the public roads, alleys, highways and thoroughfares thor-oughfares of the County of Washington, Wash-ington, State of Utah, and of all unincorporated towns in said county, coun-ty, under authority of an ordinance entitled "An Ordinance Granting a Franchise to the Los Angeles & Salt Lake Railroad Company," passed and granted by the Board of County Commissioners of Washington County, Utah, on the 20th day of April, A. D. 1926, the Utah Parks Company having succeeded suc-ceeded to the franchises and rights therein granted to Los Angeles and Salt Lake Railroad Company, together to-gether with the further franchise and right to place and maintain such additional poles and wires, with the necessary or convenient cross-arms, braces and other necessary nec-essary fixtures, over, upon, along, or across the public roads, alleys, highways and thoroughfares of the County of Washington, State of Utah, and of all unincorporated towns in said county, for the purpose pur-pose of operating public telephone and telegraph lines, as the Utah Parks Company shall find necessary neces-sary or convenient in the conduct of its business; PROVIDED, however, how-ever, that the poles erected hereunder here-under shall be placed and the wires upon them be kept at such elevation and so attached and secured se-cured as to avoid danger to persons per-sons and adjacent property, and so as to present the least possible obstruction and inconvenience to the traveling public. SECTION 2. The said Utah Farks Company is also hereby granted the right to permit other companies or persons that have the franchise right to construct, maintain and operate public or private telephone and telegraph lines in said county, to attach their telephone and telegraph wires, together with other necessary neces-sary fixtures, upon the poles of the Utah Parks Company erected heie-under. heie-under. SECTION 3. The period of this franchise shall be fiftv vears. sub ject to the terms and conditions hereinbefore contained, and the rights herein granted shall not be exclusive and . the Board of County Commissioners reserves the power to grant to others like franchises and privileges, except that no franchise shall be granted to any person or company to hereafter construct andor operate high tension ten-sion power lines with wires carrying carry-ing heavy currents of electricity in close proximity to the telephone or telegraph line of the Utah Parks Company, or crossing the same, without providing and requiring re-quiring in such power line franchise fran-chise that the same shall be constructed con-structed andor operated in such a manner as not to interfere with the wires and circuits of the Utah Parks Company installed hereunder. hereun-der. SECTION 4. This ordinance shall take effect twenty days from and after the date of its passage. The members of the Board of County Commissioners voting upon the aforesaid franchise were as follows: Those voting aye: H. T. Atkin, F. J. Bowler and Morris Wilson, Jr. Those voting nay: None.
