ACT-019-008 IN THE MATTER OF THE APPROVAL OF THE NOTICE OF INTENT AND RECLAMATION RECLAMA-TION PLAN SUBMITTED BY MICHAEL SHUMWAY AND JAMES KEOGH, BUCK CANYON CAN-YON COAL MINE, GRAND COUNTY, UTAH. THE STATE OF UTAH TO ALL OPERATORS, TAKERS OF PRODUCTION, MINERAL AND ROYALTY OWNERS, AND PARTICULARLY ALL PERSONS INTERESTED IN TOWNSHIP 18 SOUTH, RANGE 23 EAST, SLBM, GRAND COUNTY, UTAH. Notice Is hereby given that tentative approval was given by the Utah Division of Oil, Gas, and Mining, to Michael Shumway and James Keogh, P.O. Box 1449, Moab, Utah 84532, to commence contour str ip and auger mining of coal on portions of Section 36, Township 18 South, Range 23 East, SLBM, Grand County, Utuh. The name of the person representing this partnership In the matter Is James Keogh, P.O. Box 1449, Moab, Utah 84532. Michael Shumway and James Keogh have fulfilled obligations under the Mined Land Reclamation Act of 1975 (Section 40-8, U.C.A., 1953 as amended) and will employ the following reclamation techniques tech-niques on 25 acres of which only 4 acres will be disturbed at any one time. The land affected Is on a State mineral lease: ' During Operations: 1) Mining will be conducted conduct-ed In a safe and orderly manner with full compliance of applicable State and Federal regulations. 2) Surf Iclal soil material will be lifted and stockpiled prior to mining. 3) Mining will utilize a haulback method to keep the disturbed area to a minimum. 4) All spoil materials will be placed In the pit and regraded to approximate original origi-nal contours. No spoil will be cast downslope of the coal outcrop. Excess spoil will be placed In constructed side hill and head of hollow fills. 5) All regraded slopes will be planted as soon as possible to prevent soil loss. After Operations: 1 ) Extraneous debris, scrap and buildings will be removed from the surface. 2) The haul road will be reclaimed or left In a stable condition for aji approved post-mining use. 3) Revegetatlon maintenance mainte-nance will be continued until the disturbed areas are stabilized. stabil-ized. Reclamation performance surety will be established upon final approval of the reclamation reclama-tion plan. Any person or agency aggrieved by this tentative decision Is hereby requested to submit written protest within 30 days of September 2, 1977, to the Division of Oil, Gas, and Mining, 1588 West North Temple, Salt Lake City, Utah, setting forth factual reasons for his complaint, and thereafter, there-after, at a time and place heretobe established, appear before the Board of Oil, Gas, and Mining, to show cause, If any there be, why this plan should not be approved.
