Show I). S. Court Jury Receives S. L. Libel Case A Jury of seven men and five women Wednesday afternoon received re-ceived instructions from Judge Tillman D. Johnson in federal district dis-trict court at the conclusion of arguments in the $400,000 lawsuit brought against Arthur Derounlan, author of "Under 'Cover," by a quartet of Salt Lake City men. . The Jurors retired to the Jury room to begin their deliberations shortly after the afternoon session of the trial's sixth day began at 2 p.m. During the morning the Jury heard final arguments from defense de-fense attorney A. H. Nebeker, and Knox Patterson, chief counsel for the plaintiffs. . Summations of both sides reiterated reiter-ated the main points previously presented In direct and cross-examination of the four J. H. Mc-Knight Mc-Knight Jeremiah Stokes, C. . F. Allen and Ernest HolUngs. Each of the plaintiffs charges that "Under "Un-der Cover" contains libelous and defaming material regarding them and asks 1100.000 damages. Mr. Nebeker, in reviewing the Issues of the case, spoke for an hour and a half, followed by the 45-mlnute address to the Jury by Mr. Patterson. Judge Johnson, In considering recommendations presented by both parties In the absence of the Jury Tuesday, indicated he did not believe that punitive damages should be assessed against the defendant, de-fendant, since no malice or ill will on the part of the author had been shown. He did not reveal whether he would Instruct the Jury on that point Actual and punitive damages of $50,000 each are asked by the plaintiffs. |
