Show JUSTICES HOLD ON They Refuse to Surrender Office and Test Case Will Be Filed. The question i'n the conflict of Justices which came up before the City Council last evening has been referred to City Attorney Nye with Instructions to test the constitutionality of the law enacted by the last Legislature which abolished the five precincts and made the whole city one. The matter came to a focus when City Recorder J. O. Nystrom served notice upon the Justices of the Second, Third, Fourth and Fifth precincts, and Justices C. M. Nell son and Gustavo Kroeger refused re-fused to comply with the order and turn their records and papers over to Justice Frank H. Clark, elected last fall as Justice Jus-tice of the city, or to J. O. Nystrom- in his capacity as ex-ofnelo clerk of the City court. Justice Morris Sommer and Justice Dana T. Smith turned over the property of their offices upon notification. The others hold that there is no law requiring them to turn over their records and papers pa-pers to any court or any other ofticer. |
