Several Important recommendations .are made by the Attorney-General, the moat Important of which ia In relation to the failure of the Schettler bank, . the recommendation being aa follows: "The startling facts disclosed by the rait against the Schettler private bank, instituted by this office for the purpose pur-pose of winding up the affairs of said bank, very forcibly demonstrate the absolute necessity of requiring such banks to be examined by the ' State Bank Examiner. The law as It now stands does not authorise tha examiner to examine private banks. This is clearly a serious oversight in the law. It is plain to be seen by the facts developed de-veloped In this case that in order to irotect the depositors the State Bank Examiner ought to be empowered to examine private banks, as well as corporate cor-porate banks." - The Attorney-General asks thut section sec-tion 2441 of the Revised Statutes of 1898 be amended to meet the recommendation. recommenda-tion. The report, also recommends that the law in relation to burglaries and house-breaking be amended, as under the present law confusion and difficulty are experienced in the prosecution of those charged with these offenses. At times it Is impossible to prove that a house-breaking took place in the daytime day-time or that a burglary took place in the nlghtlme. The report recommends that the law upon burglary and housebreaking house-breaking be so amended as to constitute consti-tute burglary in the first and second degree. It is further recommended that the statutes be amended relating to forgery for-gery so that they will cover the forging forg-ing with Intent to defraud of what is known as service letters Issued to railroad employees upon which they can secure passes on the railroads. The report deals with and makes recommendations rec-ommendations for the control of corporation, cor-poration, both local and foreign. The report also shows the number of cases in which the State is interested, which have been appealed to the Supreme Su-preme court and the disposition made cf each case. |
