Show Wagers on Result in fourth Precinct, in .5 . Which theouncilman Was Candidate for Re-Election, Alleged to Have Been i . Made by Him. - Section 897 of the Revised Statutes of Utah reads as follows: I "It shall be unlawful for any candidate for any public office, before be-fore or during any election provided by law, to make any bet or wager with a voter, or to take a share or interest in or in any man-tfecome man-tfecome a party to any such bet or wager, or to provide any ha hex to be used by another in making such bet or wager, upon any tvant or contingency whatever, arising out of such election. Nor hall it be lawful for any person, directly or indirectly, to make a .': bet or wager with a voter, depending upon the result of any election provided by law, with the intent thereby to procure the challenge of -Bnch voter or to prevent Jrim from voting at such election. Any vio- lation of this section shall be deemed a misdemeanor." The penalty for violation of this section is a fine of not to exceed (300, or imprisonment in the county jail for a period not to exceed six months, or both such fine and imprisonment, in the wisdom of the court - ...... ' It is stated on reliable authority that Councilman Hartensteln posted money on the late election, and that by so doing do-ing he laid himself open to arrest and trial on this charge. Hung Around Betting Places. .It is known that Councilman Harten-X Harten-X stein was about the offices of Dewitt B. Lowe A Co., where pools were sold on election day. and it has been. stated that he placed money on the results. De Witt B. Lowe. Sr., was asked by The Telegram today to state whether or not he knew that Councilman Hart-' Hart-' enstein had placed wagers on the results re-sults of the election. Mr. Lowe said: Will Answer Only to Court. - "My business with the bettors who placed money on the results of the elec-' elec-' tion is secret. I am not at liberty to show you my books. It would be a violation of "business confidence. There is 6nly one way in whlch'I may be made to show you my books pertaining to the election bets and who placed then - "I will show my books only on an order or-der of court. That is the only thing that will compel me to do ft. I will not state personally whether Mr. Hartensteln Harten-steln or any other candidate qr. person did or did not place any. money on 'the election results." Halloran Interviewed. W. J. Halloran, real estate dealer, who was an interested observer, and who was among the crowds that thronged about the De Witt B. Lowe & Co. betting bulletin board, and that of W. B. LaVielle during election day, was asked this morning if he knew whether or not Councilman ' Hartensteln Harten-steln had placed any money on the "lection results. He said: Will Wait Official Count. "I do not care to go into that at this time.' If the official count of the ballots bal-lots of the Fourth show that Mr. Hartenslcin is re-eleoted. it will then be time to go Into that matter. At that time, I believe, the question will be brought up officially. Investigation may be made after the official returns have teen brought in, in the event that Councilman Hartensteln is declared to be returned to his office. Further than that I do not care to make a statement, or say anything further." Hatenstein Money Plenty. From present indications it Is more than likely that Councilman Hartensteln Harten-steln may be asked to explain where a certain sum of money that was bet for him to win came from. "There was considerable Hartensteln money In evidence on election day." eaid one betting broker, who acted as agent for many bettors Tuesday, "but where It came from or who furnished It. I will hot say unless compelled to do so by the courts." In the event that an Investigation Is begun, these betting brokers will be required re-quired by the courts to exhibit their books, and to tell what they know of Mr. Harter.steln's alleged activity in the betting business while he was a candidate for office.. |
