Insurance companies compa-nies accustomed to using the' mails to notify no-tify their policy-holders of the cancellation, cancella-tion, of policies must reform, according to a decision Just rendered In the branch Appellate Ap-pellate court. The decision was in the case wherein the Potomac Insurance company com-pany sought to evade paying W. B. At-wood At-wood of DeKalb.' 111., a fire loss. The Potomac company gave At wood a policy covering a stock of merchandise at DeKalb. Then the company decided not to carry the risk, it being agreed five days' notice was sufficient to void the policy, pol-icy, and a registered letter was sent At-wood. At-wood. The postmaster at DeKalb failed to deliver de-liver the letter to At wood until the five days had expired. The next day and before be-fore Atwood could transfer the insurance to snother company, his property was destroyed. de-stroyed. He sued the company, whose officers of-ficers took the position that Atwood had been negligent In not going to the postmaster post-master for their letter.- |
