D Walsh against the Union Bond and Finance company The case had been on trial for tor four days Both Spencer and Jelte were members mem- mem bers ers of the jury Impaneled to consider consider con con- sider aider a verdict Weiler Veiler Is clerk of Judge Thurman's division of ot the court Testifying under oath Jelte and I Welter Weiler quoted Spencer as saying I know what's right in this case Im I'm going to vote for the finance company And if 11 the rest of you jurors dont don't go with me Ill I'll hang the jury The alleged remarks remark which Judge Thurman decided were violations 01 of his repeated admonitions to jurors not to discuss the case among themselves or with others until al aU all evidence had been submitted am ano they retired to deliberate upon a i verdict were said aid to have been made by Spencer In a corridor o othe of the city and county building outside the courtroom The suit on trial involved a n trust trus fund said to total admin admin- administered by the First and Merchants Merchants' National bank of ol Richmond Va Walsh claimed he borrowed 10 from the Union Bond and Finance company March 20 1 3 and gave an assignment on the trust fund as security Since that time proceeds from Crom the fund Cund had been paid monthly to the defendant company it was wa-s alleged in the original complaint com corn plaint filed September 30 1935 Continuing the complaint averred the Union Bond and Finance company company com corn pany had paid various sums ranging rangin from 1 to to creditors of ot th the plaintiff Walsh's complaint however however however how how- ever alleged total creditors' creditors claims did not amount to more than 2500 while the defendant had received according to the complaint from the trust fund lund The court was was asked to order an accounting of ol proceeds r received receive from Crom the trust fund lund by the defendant defendant defend defend- ant to give a judgment of with interest at 6 per cent in favor favo of r plaintiff and to release the assignment as assignment assignment as- as given by Walsh on th the t trust rust fund
