Show ZTg notice Ordinance No. 46 ORDINANCE ESTABLISHING PEDESTRIAN RIGHTS AND DUTIES BE IT ORDAINED by the city council of Springville, Utah: Section 1. Sections 570 and 571 of Chapter XXIV are hereby repealed. Section 2. Pedestrian's right-of-way. When traffic-control signals are not in place or not in operation opera-tion the driver of a vehicle shall yield the" right-of-way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk cross-walk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger, but no pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close that it is impossible for the driver to yield. This provision shall not apply under the conditions stated in Section 4. Section 3. Whenever any vehicle is stopped at a marked crosswalk or at any unmarked crosswalk at an intersection to permit a pedestrian to cross the roadway, the driver of any other vehicle approaching ap-proaching from the rear shall not overtake and pass such stopped vehicle. Section 4. It shall be illegal for any pedestrian to cross a roadway within Springville City at any point except within a marked cross walk or within an unmarked cross walk at an intersection ; except, where there is no intersection within 300 feet of where a pedestrian desires to cross a roadway, the pedestrian may cross a roadway at such point but shall yield the right-of-way to all vehicles upon the said roadway. Section 5. Any pedestrian crossing a roadway at a point where a pedestrian tunnel or overhead pedestrian crossing has been provided shall yield the . right-of-way to all vehicles upon the roadway. Section 6. Between adjacent intersections at which traffic control signals are in operation pedestrians pedes-trians shall not' cross at any place except in a marked crosswalk. Section 7. Notwithstanding the foregoing provisions pro-visions of this act every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian pedes-trian upon any roadway and shall give warning by sounding the horn when necessary and shall exercise exer-cise proper precaution upon observing any child or incapacitated person upon a roadway. Section 8. A person wholly or partially blind, and n0 other person, may carry a cane or walking stick, white, or painted white in color and seven-eights seven-eights of an inch or more in diameter, as a means f protection and identification as an indication to aH traffic to exercise extraordinary care to avoid accidents.- Section 9. Pedestrians shall move, whenever Practicable, upon the right half of crosswalks. Section 10. Where sidewalks are provided it snall be unlawful for any pedestrian to walk along and upon an adjacent roadway. Section 11. No person shall stand in a roadway Sr the Purpose of soliciting a ride from the driver ot any vehicle. ; Passed by the City Council of Springville, on the 16th day of July, 1956. A. W.
