GRAND JURY ON KIDNAP CASE TACOMA, Wash., June 18 (U.R) A federal grand Jury will convene con-vene here tomorrow to hear evidence evi-dence against Harmon M. Waley and his wife, Margaret, confessed kidnapers of nine-year-old George Hunt Weyerhaeuser. At the same time the jury will hear evidence against William Mahan, alleged brains of the kidnaping kid-naping trio, who is still at large. . The grand jury will be asked to return indictments against the three acusing them of violation of the Lindbergh kidnap law, using the mails to defraud and extortion. Belief was expressed by some government officials that the Waleys who are being held in custody cus-tody in the county jail at Olympia, may enter pleas of guilty to the kidnap charge when brought to trial. "The Waleys can plead guilty to kidnaping, providing the death penalty is not asked," United States District Attorney J. Charles Dennis stated. "Even if they plead guilty, the court can refuse the plea and demand to hear testimony." testi-mony." The date of trial will depend upon the court. It is believed, however, that Judge E. E. Cush-man Cush-man will set an early date. WASHINGTON, June 18 (U.R) Director J. Edgar Hoover of the federal bureau of investigation said today that William Mahan, new public enemy No. 1, had been planning kidnapings for more than a year anc even ha'd dug a pit in Idaho in 1934 to hold his intended victim. Mahan now is hunted on charges of kidnaping young George Weyerhaeuser Weyer-haeuser at Tacoma, Wash. Mr. and Mrs. Harmon M. Waley already al-ready have been arrested on charges of participating in the crime. . "The pit was found near Spirit Lake, Idaho, by citizer.s on June 5, 1934," Hoover saw. "We investigated in-vestigated and took photographs of it at the time, but we did not learn that Mahan had built it until after, we began the Wcyer-haeuer Wcyer-haeuer investigation. Hoover said, meantime, that reports re-ports that Mrs. Waley was about to become a mother were erroneous. errone-ous. "A physician's examination proved otherwise," he said. BUTTE, Mont., June 18 (U.l!) Evidence that William Mahan, sought in connection with the Weyerhaeuser kidnaping case, is still hiding somewhere in the vi cinity of Butte became more and more conclusive today. Latest evidence pointing to thai fact was the report late Monday night of the discovery of a Lugar automatic where it had been thrown in the city dump. The theory was immediately advanced ad-vanced that the g"un, a cumbersome cumber-some affair had been cached, there by Mahan in the hopes 'it would not be discovered until the hunt had died down when he could return re-turn for it. The gun was of a type that can be used, through an exchange of clips, as a pistol or automatic ; rifle with the same effectiveness ' of a sub-machine gun. It was wrapped in cither a Salt Lake City or Tacoma newspaper when found. |
