Arguments wop heard in appeals of the company from federal court decrees dismissing proceedings proceed-ings designed to enjoin the city from constructing con-structing traces paralleling those of the company along Market street and in other parts of the city. The company's attorneys argued that the lower court's refusal to enjoin the city impaired the company's contract and deprived de-prived it. of Its property without due process proc-ess of Jaw, as well as permitted the city to construct a new public utility without first attempting to purchase the company's com-pany's system as provided under tho city's charter. Construction of additional tracks, attorneys attor-neys for tho city argued, vas -necessary to meet increased demands for transportation. |
