SAN" FRANCrsCO, Nov. 22. Revelations Revela-tions of alleged crookedness in the prosecution prose-cution of many cases, criminal and civil, In San Francisco courts, Including: a charge that attempts were made to manufacture manu-facture evidence against Mrs. Rcna Herman Her-man Mooney, were contained In a report made public here today. Tho report aa printed here bore the signature sig-nature of John B. Densmore, director of employment, and was addressed to William Wil-liam B. Kilson, secretary of labor at Washington. The report was dated November No-vember 1. Dr. Densmore would not deny he made the report, but intimated it must come through official sources at Washington. Wash-ington. Densmore was sent to San Francisco Fran-cisco some time ago by Secretary Wilson to investigate certain departmental affairs. af-fairs. Got by Dictaphone. Long stenographic reports of alleged conversations, obtained by dictaphones, deal with alleged acts tending to invulve a former justice of the California supreme court, a member of tho public prosecutor's prosecu-tor's office and a number of persons who have figured In cases of national interest, including the famous San Francisco graft cases. In one instance there Is mentioned payment of $410, UOO, with allegations that this amount was passed. Mrs. Mooney, the object of the alleged attempt to manufacture evidence, is the wife of Thomas J. Mooney, under sentence sen-tence of death for murder in connection with the preparedness day bomb explosion here, July 22, 19. She was indicted with her husband and three others upon ten counts of murder, covering the ten deaths from the explosion. .She was acquitted ac-quitted on one count, four counts were dismissed and she now is out on bail awaiting disposition of the other charges. Six Months- Inquiry. More than forty columns of newspaper space were fdled by the report. Details of alleged meetings between an official and certain notorious characters were given. A summary of "facts" was appended ap-pended to the report, alleging conditions existed that justified the federal government govern-ment in taking action to assure to the bomb explosion defendants "their rights." Mention was made in the report re-port of instructions to make a "secret and altogether informal inquiry' into the Mooney case, and the summary of "facts" given all bore 'on the alleged unfairness un-fairness of the bomb case trials. I All the alleged irregular incidents recited re-cited were brought to bear upon the main conclusions as to the writer's findings in the bomb cases. Evidence adduced at the bomb trials ; was analyzed and the alleged taint on the'testimony set out. Four of the bomb cases have been tried. In the first. Billings Bill-ings was sentenced to life imprisonment. In the second, Mooney was sentenced to be hanged. In the third and fourt h, Weinberg and Mrs. Mooney were acquitted. acquit-ted. Four of the ten counts against these defendants were dismissed. Mrs. Mooney, Nolan and Weinberg were released on bail. Never Made Public. Two appeals for a new trial were made for Mooney by the trial judge. President Wilson sent messages to Governor W, D Stephens which never were made public. Many labor organizations took up the fight to get Mooney a new trial. World-wide Interest finally was shown in the case. Summarizing 1he published findings today, to-day, the report said "pi act ically the whole case against Mooney. Killings and Mrs. Mooney was made to order." The conclusion, the report states, was reported report-ed through direct evidence that seemed sufficient and also by the alleged facts adduced in the investigation tending to show corruption. The report alleges that certain things "render" it incredible that he (naming an official) should be cither impartial or honest in the conduct of a case of this nature; that he is and has been for some, time past co-ope,rai ing with notorious jury- and case-fixers." All the conclusions reached in the report, re-port, summed up in a set of three "facts." bore on the bomb case prosecutions and the writer's opinion as to the fairness of the trials. Discussing them, the report re-port said "it would be well within the province and privilege of the federal government gov-ernment lo devise some means by which, without giving offense to tiie duly constituted con-stituted and honestly functioning authorities authori-ties of l3an Francisco, the defendants might be assured of their rights." |
