Show SAYS HIS CHARACTER HAS BEEN MALIGNED Dr. J. E. Young of Bountiful Sues Dr. B. L. Kesler for Damages. Dr. J. E. Young of Bountiful filed suit yesterday in the Third district court agaiiist Dr. B. L. Kesler of the same place to recover $20,000 damages for alleged defamation of character. The plaintiff alleges that a false and defamatory statement was made by his brother physician in the issuance of a death certificate for Thomas Fearnley of Bountiful to the effect that the man died of i( Morphine poisoning, narcosis from an overdose of morphine. 1 ' The plaintiff alleges that on December Decem-ber 4, 1910, he was called to attend Mr. Fearnley. It is further alleged that later in tho day Dr. Kesler was called to the patient's bedside and was told that the plaintiff had given the patient morphine. The patient died about two hours later, at 9:30 o'clock in the evening, eve-ning, according to the attestation of the plaintiff, and on December 8 the defendant de-fendant is alleged to have forwarded to Dr. T. B. Beattie, state health commissioner com-missioner the death certificate which the plaintiff alleges to be false and defamatory. de-famatory. The plaintiff sets forth that as a result of the defamatory character of the said health certificate his reputation reputa-tion and practice as a physician have been injured in the sum of $20,000, for which he prays judgment of the court. |
