QUESTIONS STATUS AS TO VOTING RIGHTS Ballots of Inmates of County Coun-ty Infirmary May Decide Justice of Peace Contest, The question of whether inmatea of the county infirmary are legul and permanent perma-nent residents of the voting district In which the infirmary 1b situated was raised In the district court yesterday In the case of L. C. Mariner against F. M. Bishop and may prove the deciding" factor In Manger's suit to oust Bishop from the office of ,1uetice of the peace in precinct No. 2. Half a dozen inmates of the infirmary in-firmary who voted ' for Bishop were brought Into court by the plaintiff, who sought to bring- out that they .were not legal residents of that district in which the infirmary is embraced. This is but one issue, however, on which Mariner seeks to win tfie office for which he was defeated at the last election by Bishop by a margin of thirteen votes. He contends that Bishop is not a resident of precinct No. 2, Inasmuch as ho resides on the north side of the street marking the northern boundary line of the district. dis-trict. It was brought out in the hearing: yesterday yes-terday that Bishop has met with much hard luck In his "efforts to keep within the ever receding boundary of the district. dis-trict. Some years ago he was a resident of the Waterloo district and justice of the peace for that district. Suddenly the cHy annexed that region and Bishop was forced to move farther south to be lu the county. Again the chanplnsr city limits forced him southward and finally he took up his residence on Ma.lor avenue, well beyond what was then the city limits. Keeling comparatively secure for the nonce, he proceeded to build himself a new home, but scarcely had he finished it than the city "fell upon him" again and fixed its boundary line down the middle of Major avenue, thus including Bishop's house and courtroom. This time Bishop compromised as to the situation by moving mov-ing his courtroom across the street, but continued to reside on the north side of the street. The matter of duplicate tickets of the Democratic and Progressive candidates at the last election also was brought out in the hearing, Mariger alleging that fourteen four-teen votes plainly intended for him had ben thrown out because the voters had placed a cross in the circle over both the Democratic and Progressive party emblems. em-blems.
