Show SENTENCE VACATED-IN COUNTERFEITING CASE Action Taken That Dante Bagnari May estify for Bismarck Aloisio. In order that he might be a witness for the defense in the case of Bismarck Aloisio, charged with possession of counterfeit devices, the sentence of Dante Bapnari, convicted on a like charge, wab vacated yesterdav by the nrHur rtf .Turlfrrt Tillman F IUc the United States district court. As a result, Bapnari remained in the county jail yesterday instead of going to Leavenworth, there to begin his term in a federal prison. Bagnari insists that Aloisio is innocent in-nocent of any knowledge of the intent of himself when he induced Aloisio to purchase an assayer's furnace some months ago. He insists as does Aloisio, that the latter was told by Bagnari that ! the furnace was to be used in smelting high-grade' ores. The furnace was -found bv T. J. Callaghan, secret service l agent of tho United States, installed in i a dwelling house on the west side. With 1 it were found molds for making counterfeit coins. Action to have the sentence of t Bagnari vacated that he might appear c at the trial of Aloisio as a witness, was l taken by J. H. Stockman, attorney for 1 the accuped man. Bagnari was sentenced ! last week after entering a plea of , guilty to tho charge against him. According Ac-cording to the order of the court va- r cating his sentence, he will again be taken before Judge Johnson on January Janu-ary 17 for resentence, at which time it is expected that he will have testified iu the case of his friend, Aloisio. United States Marshal Aquila Ne-beker Ne-beker left Salt Lake for Fort Leavenworth Leaven-worth yesterday afternoon at 5:15 o'clock, having iu custody Don Emanuel Page, colored, and Leonard Asher, both sentenced to serve terms in the federal fed-eral prison in Kansas. Page pleaded guilty to having forged a postal money order, and Asher to liaving stolen $5000 at Ogdcn while he was in charge of the money as an express messenger during interstate transit. |
