Show FISHER CASE TAKEN UNDER ADVISEMENT Argumonts on. the alternative writ of prohibition issued by the supreme court against Judge C. W. Morse of the district dis-trict court in the casa of Albert Fisher against, the Union Savings & Investment Invest-ment company, were heard j-osterday afternoon, and the case was taken under un-der advisement. Attorneys for the defendant company com-pany declare that Fisher, who is a stockholder in the company, has no legal le-gal right to ask the district court for a receivership for tho companjr until he has exhausted prior means of obtaining justice. Fisher sought a receivership audi an accounting alleging that officers of tho company had misappropriated the company funds. Tt was the contention of the company in seeking the writ, of prohibition under un-der which Judge Morse was restrained Monday from hearing evidence in the case, that Fisher must, under tho statute, stat-ute, take his complaint to the secretary secre-tary of state and to the attorney general gen-eral in case the stato bank examiner finds ho has cause for complaint. |
