Most of Wednesday's Wednes-day's session of tho District court was spent in arguments for and against a non-suit which the attorneys for the Southern Pacific Railroad company are seeking In tho action brought by Mrs. Mary R. Schuyler for the death of her husband. Charles Schuyler. Schuyler was kllleo In tho Gartney railroad wreck over a year ago. The defense de-fense Interposed a motion for a non-suit, because it Is claimed that Schuyler was an Intruder or trespasser on tho express car when he met his death and not engaged en-gaged in his duties at the time. After the motion had been argued. Judge Howell announced that he would take the matter under advisement until Thursday morning.
