The case of the Stale of Utah vs. former Police Ofliccr George Kaleigli and Attorney William Newton, in which tho defendants were charged with conspiracy in connection with tho notorious McWhiiler poker game, was dismissed by Judge Armstrong Thursday, on motion of Sorcn X, Christenscn, Chris-tenscn, attorney for tho defendants. District Attorney Lonfbouiow was present, but said ho would not oppose the motion, as ho presumed l.ho court would not reverse itself by denying the motion, precisely the same iios-lion iios-lion having been passed upon in The Sheets case swine months ago. The motion, in briff, was based upon tho ground thai the intorinafion against Haleigh and Newton, while being for ii misdeamanor (criminal conspiracy), charged the dofondunta with tho com- j mission of various nets constituting felonies, for which alleged acts tho defendants de-fendants had never been examined bo-fore bo-fore a committing magistrate. As before staled, the same motion was granted by .Indgo Armstrong som? moniliH ago in the Sheets case. At Hint time an appeal was taken to the Su-r.rcme Su-r.rcme court, but was later dismissed by the prosecution, thereby admitting the correctness of Judge Armstrong rf ruling. The ruling of Judge Armstrong in the Raleigh-Newton case finally disposes of that matter. |
