The Supreme court yesterday handed down an opinion affirming the Judgment Judg-ment of the District court for Weber county in' the case of Neal Hern, appellant, ap-pellant, against the Southern Pacific company, the Ogden & Lucin Railroad company and George Beckham, respondents. re-spondents. The lower court entered a non-suit In the ense of the Ogden & Lucin company and Beckham, -and on the trial of the cause , against the Southern Pacific company the verdict was in favor of the defendant. The opinion of the Supremo court was written writ-ten by Justice Straup and concurred in by Chief Justice Bar tch and Justice McCarty. buc3 tor a Balance. Walter Love filed suit in District court yesterdny against Rose E. Llnd-strom, Llnd-strom, the Home Investment company and F. M. Powell to recover a balance of $1G0 alleged to bo due for work as a carpenter on a house built for Mrs. Lindstrom by Powell, and seeks to enforce en-force a mechanic's lien against the property. It Is sought to make the claim of the Home Investment company com-pany secondary to his own. Demands Damages. Hannah Snllno filed suit In District court yesterday against Albert Thomas, claiming damages in the sum of $1550. In her complaint she alleges that on July 1 last Thomas violently assaulted her, knocking her against a water tank and hydrant, severely and permanently injuring her. Asks Foreclosure on Mortgage. The Deseret National bank filed suit yesterday against R. B. Garff and George P. Garff, doing business as Garff Bros., for a balance of ?1400, alleged al-leged to be due on a note, together with 5224 unpaid Interest. The foreclosure of a lien on a flock of sheep Is asked. Edwards Given. Judgment. A jury In Judge nitchie's court yesterday yes-terday gave a verdict in the case of II. C. Edwards against Harry E. Lee. aw;ardlng the plaintiff $171S on a note. The note was given In connection wtlh the promotion of, a mining company by A. G. Lamson. Two Years in Pen. In Judge Armstrong's court yesterday yester-day Joe Bennett, convicted several weeks ago of a felony, was sentenced to two years in the penitentiary. In the case of George Williams, the motion for a now trial was denied and the undertaking on appeal abandoned. Williams was ordered to the penitentiary peniten-tiary on the former commitment. In Judge Morse's court yesterday a decree wa3 given to T. II, Robinson against George S. Bell for $1020.50. |
