Hlckey against the Rio Grande Western Railway Rail-way company, yesterday returned a verdict In favor of the defendant and the action was dismissed without prejudice pre-judice by District Judge Booth. The case is one in which the plaintiff plain-tiff sought to recover damages ln the sum of 530.700 for personal Injuries sustained as a result of alleged negligence negli-gence on the part of the defendant. Beforo the Introduction of any evidence evi-dence the defendant moved a non-suit, which wna denied by the court. At the conclusion of the trial another motion was made by the defendants asking that tho Jury be Instructed to return a verdict for the defendanL The motion was argued and granted. Upon motion of the attorneys for the plaintiff the case was dismissed without prejudice and the plaintiff given permission to !bring another action. |
