fellow who held up and shot John H Klmball In the arm near his home on Monday evening appeared In the Police court yesterday to answer to a complaint I charging him with assault with Intent to rob Kimball To this complaint he I promptly pleaded guilty He appeared Ito I-to be a little surprised however when I a second complaint was read charging him with the same offense but substituting I substi-tuting the name of E AV Reese for that of KImball but his response of I guilty was equally as emphatic In default of 53000 baum In each case he was sent to the county jail lo await the action of the District court Both of his victims were In court yesterday and while Mr Kimball thoroughly Identified Dayton his assailant as-sailant Mr Reese was not at nil confident con-fident and appeared to be considerably pleased when Dayton pleaded guilty So far as the Reese case Is concerned all the evidence that the police now have against Dayton Is the defendants i own confession No one has yet been found who could Identify l him There I I Is doubt In the minds of some as to 1i 9f Samuel Russell i Tho young man who captured the hold up I whether he could be convicted on that alone In the
