the Time of the Killing of Col Proussc Also Bought Handkerchiefs Handker-chiefs Which Were Used as Masks Lynch Supposed Murderer of Prousse Hot Moved by Testimony The preliminary hearingof James Lynch J and Robert L King alias Bob kartell charged with murder In tho first dgree In Inflicting a fatal gunshot gun-shot wound on Cal George Prousse at the Sheep Ranch gamblinghouse on the morning of September llth a begun be-gun before Justice Nielsen yesterday morning at 10 oclock The prosecution was conducted by Assistant County Attorneys Van Colt and A B Sawyer Jr and W F Wanless appeared for I the defense The examination of witnesses wit-nesses for the State occupied the attention at-tention of the court until 430 oclock when the prosecution rested and an adjournment I I ad-journment was taken until 1030 today Edward Nlssen Assistant City Engineer En-gineer testified to the correctness of a plat of the gamblinghouse which he had prepared showing the Interior locations I lo-cations of the entire second floor and the furnishings of the room Including I cleen holes In the furniture and Avails which were made by nine bullets I THOUGHT IT A JOKE AT FIRST I Paul Johnson an employee of the house testified that he was starling I to leave the room when he was confronted con-fronted by 1 three masked men whose faces were covered with blue handkerchiefs handker-chiefs with white spots Thc holdups called out Throw up your hands Witness thought It a Joke at first and began to laugh but when one of thc robbers said lo John Rogel another employee Gd dn you hold your i hands higher he then realized that the holdup was a reality The foremost fore-most of thc rolUers then advanced toward to-ward the middle of the room In the direction of Col Prousse who was reaching for a gun In the drawer of thc faro table at which he sat The robber rob-ber acted In a wild manner and both he and Col Proussc llred about the same tred time the robber he thought firing first COL PROUSSES EXCLAMATION Thc robber fell to thc floor and Col Prousse said I have got one of them but I guess they have got mei Col Prousae was then assisted to 3 backroom back-room by two men whom Johnson could not name Johnson then related the entire transaction as he saw It and was crossexamined at great length but bfl i testimony was unshaken When asked who did the shooting Johnson pointed to Lynch and said That is the man Lynch who hat been rcad Ing Jicro turned and looked at John son andthen resumed his reading withOut with-out showing either anxiety or excitement excite-ment King he said was of the size and appearance of one of the other robbers but witness could not Identify I him positively I W S Barnett who had been running the roulette table gave testimony cior c roboratlve of Johnsons statements SURGEONS EVIDENCE Dr S H Pinkerton testified that he had attended Col Prousse at St Marks hospital and has hold a postmortem examination of the body Col Prousse he said had died from acut peritonitis from a gunshot wound the bullet hayIng hay-Ing entered the right hip passing through several folds of the intestines piercing several of them and lodging in the bones of the pelvis on the left side The bullet on which a piece of bone was still clinging was offered In evidence evi-dence denceIDENTIFICATION IDENTIFICATION OF KING William Meyers a clerk In the clothing cloth-ing store at 62 East Second South street teatlllcd that he sold three handkerchiefs hand-kerchiefs and a valise with a strap to a stranger at S30 p m September 10th and positively Identified King as the party who purchased the articles I lng had llrst purchased the handkerchiefs and then asked for a valise a good strong one that would not wear out When about to leave King observed a strap on another valise and then purchased pur-chased a strap a3o after which King requested Meyers to wrap the goods up which MeSors did The valise strap two of the handkerchiefs and the wrapping paper were Introduced In ev l deuce and Identified by Meyers Meyer Mey-er said that he knew King from his voice face and general I appearance and a rigid crossexamination failed to weaken Meyerss posltlvencss as to the identification SAW MEN RUNNING AWAY I William Wittenberg l messenger boy aged 17 years said he was In the Vienna I Vien-na safe when the shooting Occurred He wont out the back door to the alley and saw two men come from the direction di-rection of the SliceKranch run south through the alley and enter the Bide door of the Casino saloon on Second South street A heavyset short man was In tront and as he ran he pulled a mask from his face The other man who was taller und not so heavy stopped under the light at the saloon aide door an removed n mask from his face also Witness then ran down the alley and entered the saloon at the front door Both the men were at the bar when Wittenberg came In Thc heavyset one wanted Wittenberg to drink with him but the taller one turned at once and went outtije backdoor back-door Wittenberg was sure that fhc taller of the two men was King from hla general appearance and from his red sore eyes There wore five other oth-er men In the barroom but these two mon lookcdnervous Wittenberg then went out to find an officer Witten bergs statements were not shaken by a crossoxamlnatlon SHEETS SHOWS GUNS Detective Sheets was the last witness examined and he offered In evidence two guns that he had found the mornIng morn-Ing aftertime hooting on the outside ota ot-a back wtndaw at tho Casino saloon one was a Kcallber ulxshooter with onr clarity chamber the other gun was I liveshooter of the same caliber with three ompty chambers The guna were found In such a place he said that on account of old barrels and rubbish rub-bish about thorn hey mmmut have ben thrown from thc Inside of the building At the conclusion of Detective Sheeto testimony thc prosecution reste and adjournment was taken until un-til 10 oclock this morning |
