Show I I PAID BY FA NSWTR Over 100000 Turned Over to Nevada Company I END OF NOTED LITIGATION Three Actions Pending an Appeal All Dismissed and the Judgments Marked Satisfied in the United States Circuit Court Besides Money Payment thc250 Shares of the Nevada Company Valued at 315000 Go to tho Company Farnsworth Mortgages Property The litigation which has been in progress pro-gress for a couple of years between the Nevada company and J G Phelps Stokes oC New York as plaintiff and P T Farnsworth of this city as defendant defend-ant was brought to a close yesterday the parties having agreed upon a set tlement and the money being paid over by the defendant At the request of Mr Farnsworth the exact terms of the settlement were not given out but It was learned that It was largely In favor of the plaintiff and that the amount paid by Farnsworth was between be-tween 100000 and 110000 besides 250 shares of the Nevada company worth about 15000 In the flrst Instance the Nevada company com-pany sued Farnsworth to recover 111 I I 250 money which It was alleged that Farnsworth had received from the Ne fad cpmpany as Its agent to pay for certain mining properties purchased I by him for the com anln Nevada and I appropriated by Farnsworth to his own use the allegation being that he represented rep-resented to the company that the properties I prop-erties had been purchased for 111230 more than actually had been paid for I them His defense was that he bought the properties on his own account and I then sold them to the Nevada company i com-pany pOn this suit the Nevada company recovered re-covered a Judgment for S7SC48C1 I which with interest to the present date amounted to about 55000 I Another suit brought by the Nevada company for money alleged to be owing on an accounting was for 11250 In which judgment was rendered for Farnsworth on the ground that the proceedings should have been in equity Instead of lavA I lav-A third suit was to recover from Farnsworth 525000 for 230 shares of stock of the Nevada company subscribed sub-scribed for at 100 a share and not paid for by Farnswrlh The agreement was that Farnsworth would have time to pay for the stock and that he should pay interest on me money rue court i found that the stock belonged to 3 Farnsworth and that If he paid the Interest In-terest amounting to 3300 he could I have It for the 25000 but that I It i I could not be sold out against him If he paid the interest which fell due a few days ago The stock however now Is only worth 60 a share and if It had been sold out would have left a deficiency i de-ficiency against Farnsworth of 510000 I besides the 3300 interest These Judgments rendered in the United Slates Circuit court in this city were appealed from and yesterday alt the Judgments were marked satisfied I and the appeals dismissed and Farnsworth Farns-worth paid over the cash between 100000 and 110000 thp Nevada company com-pany In addition taking the 210 shares of its own stock fr I |
