The New City Officer (Jualifieil and An-other Administration Commence Its Labors Last Acts of the Faithful Old Hoily. The old council that has for two years tteered the municipal raft retired last night, and the new came in with all its plumage. Maj or Scott was at the head of the old crev, , anions; whom were C'ouncilmcn Pick-ar- Lynn, Bpsfford, Anderson, Parsons, Pendleton, Jarnes, Heath, Karriek and Fol-lan- Of these the last two, having been elected to succeed themselves, retain their sandals and will go hand in hand with the new. The lobby was thronged when the executive's gavel fell m the desk, Mayor-Klec-t Baskin occupying a seat behind him on the rostrum. Toe mass of petitions and communica-tions that had reached the clerk's desk wero left over to the incoming sages and the old body proceed to clean up the record. It showed that the total lines assessed amounted to $1188, of which ?8fi7 was paid In labor and foTJ In cash. Received and Bled, City Attorney Hall recommended Shut an appropriation of ttVi.10 be made for the lien-cll- t of T. M. Dnshane, balance of wages due lis fireman. Iu.-hnn-e sued the city and re-covered Ihe sum for, 4:1, and flic costs, t'.'.lO. Adopted. The. Joint City and County Building com-mittee presented the following bills; Taxes 115.20; .I.e. Dowlin (superintendent), $!8; total, ?.20. Allowed. The finance committee recommended that 14280.80 the amount due from delinquent tavi-- s be placed to the credit of the assessor. Ha tiie claim presented by Couneilineu Younif, Tuddenham, Hardy, Ilyde, Follaud and Smith for back pay, the city attorney gave a double-heade- opinion. One was bused on the state courts of New York, Kau-sa-- Minnesota, Oregon and others, and the text of "Meaeliain on I'ubhe ollices," which hold that where the intruder holds the ollice hy rdcr of title and has been paid the sal-ar-up to the time that the city council or disbursing agent of the city has been not fled by the party rightfully entitled to the ollice. that he has been so adjudged by a court of competent jurisdiction, such salary so paid to the intruder cannot be recovered from the city. The other was based on the California and other courts, which hold that one entitled in law to an office, but not in possession of the same, is entitled to the salary for the term sor which he was elected, and the payment of flic salary to One in possession of the office without title will not prevent the one having the title from recovering the salary from the city. The committee on municipal laws, to whom the claims were referred, In order to get out of the difficulty us easy as possible, report d the claims back without recom-- me.no.auon. The special ro.nmittee to confer with a legislative committee with reference to a governor's mansion, recommended that the city domic to the territory ono acre of ground on tin- oust side of Stale street near the capitol KTOondl as a site. The report was adopt' il uiiil the mayor authorized to sign the deed. The following appropriations were made: Western Co g 184.90 Police departmedt expenses I9LB6 William Harlune 1,88.66 . T. M. Prc-t- change During an intermission of live minutes, Recorder Jack adjusted the archives and Mayor Scott, resuming his position on the platform, summoned ( buries E. Stanton, The formal oath .! adiuinis tcied and the new elerk of the board settled down to his labors. Mayor-Klec- t liakin then advanced and, taking the oath, stepped into tile shoes which Mayor Scott had now removed. In retiring the old leader spoke with feeling acknowl. edgmcntof of tho assistance the old crew had been to him and then introduced Mayor Itaskin, who. after the ap-plause had abated, hoped that the labors of the new would he performed with the same fidelity and ability that had cbaractcri.ed the labors of flic old.
