To the Ogden "Junction" we are indebted for the following particulars regarding the close of tho trial of the boss Purdy and Neilscm for tho ilut-der ilut-der of Janet Low, Mr. Miner, for the prosecution, ended end-ed his opening plea on Weanesday evening, and on Thursday at 10 a.m, Mr. Lascelles began the final argument for the defense, producing authorities to show that to be guilty of murder a person must have arrived at the age of discretion, and that no case cou d be cited within a hundred years in which an inlant under tilteen had been executed. At ihe clobo of the plea for the defense, which occupied an hour and a half, the prisoner NeiUon aroe and asked permission to speak, which being granted he said : i "I seo that I have no lawyer to plead for me, so I wUh to say a few words for myself. This man talks for the other boy and nothiog for me. My mother died eighteen months ago, and my father's not here. I have no one to speak for me. I have been kicked and cuffed about from one place to another sinse my mother died till I was taken by the sheriff. We did it; we are guilty, and the other boy as much as me. I should nothavo denied it atall, but this man (pointing to counsel) told me to This man says Purdy has not got so much sense as me; but I think he has got as many senses as I have, and knew as much about it as I did. My life is in the hands of the j ury ( pause. ) I ask them for mercy, if any can be given me." The judge here informed tho prisoner prison-er that his request must go to the jury. Neilson replied "then I ask the jury for mercy if they can give me any. Mr. Miner then closed the case when the judge instructed the jury as to the law, etc., and the court took a recess to await the return of the jury who finally brought in a verdict, "guilty of murder in the second degree," de-gree," with a recommendation for the mercy of the court in the case of Thos. Purdy. The court took a recess of twenty minutes, and on return pronounced the following sentence, previously asking each prisoner if he had anything to say why sentence should not be pro- . nounced. Purdy replied, "I am guilty." guil-ty." Neilsen replied, '"I have nothing . to say:" "You, Themas Purdy and Neils i Peter Neilsen, having been indicted for j the crimo of murder and found guilty of murder in the second degree, it is i the judgment of the court that you and : each of you be imprisoned at the peni- 1 tentiary at hard labor for the term of twenty years; and that the clerk issue a mittimus to the warden of tho penitentiary, peni-tentiary, commanding him to receive you and each of you into his oustody, and that ho execute the judgment of the court and the sentence of the law." |
