Show I TIBER LYNCHING AFFATB I Judge Mack Takes the Bull By the Horns at Genoa I Judgg Mack has taken the bit in his I F t teeth regarding the lynching of Adam I Uber says the Enterprise and before he left Genoa Wednesday afternoon something was heard to drop and now for the first time since the terrible affair af-fair it looks as though the criminals would be brought to justice When the judge arrived In Genoa the grand jury was waiting and Attorney Turner said he had received a telephone J tele-phone message from District Attorney I I Nagle from Carson saying he was ill and would not be able to present the I case to the jury but asked that the old grand jury be discharged on the grounds that many of them had signed a document favoring mob law The district attorney had appointed no one to act as his deputy however and the court was convened with a grand jury waiting and no attorney for the state present Judge Mack remarked that the district dis-trict attorney had not acted right in the matter and he should at once appoint ap-point a new district attorney as provided pro-vided by the statute Attorney Turner declined the appointment which was finally acbepted by Attorney Virgin under un-der some little protest Mr Virgin said he supposed the court meant he I was to act temporarily but the court merely replied Mr Virgin you are I now district attorney of Douglass county and you may remain so for months Judge Mack discharged the old grand jury because three of them had signed i a paper favoring mob law Judge Macks remarks were to the point and shook things up in such a way that something will happen in Douglass county before many days The new grand jury to meet Jan 12 was then drawn |
