Show GOVmNORSHP IS AT STAKE NEVADA BALLOTS ARRIVE I SALT LAKE Clerk Goodrich of Lincoln County on His Way to Carson City Contest to be Heard Monday I The supreme court of Nevada will decide de-cide on Monday or within a few days thereafter whether or not Governor Sadler is to remain as the chief executive execu-tive of that state or J H McMillen is to take his place The hearing of the contest which has been awaited with interest for many months will begin on that day County clerks with big ballot boxes sealed and locked are on their way from various counties to Carson City They are to turn over to the court these ballots that they may be counted and the question settled H J Goodrich Good-rich clerk of Lincoln county is one of them on his way He came through Salt Lake and is at the Cullen He will leave on Sunday for Carson City Upstairs Up-stairs In his room at the Cullen he has several boxes which he guards with his life for on their contents may depend the governorship of the state He will watch them with great vigilance until they are delivered to the supreme court and his responsibility ceases The law of Nevada concerning election elec-tion contests is quite different from that of most states The supreme court has original jurisdiction of contests Its members count the ballots listen to the arguments and render their decision which settles the matter Governor Sadler was the silver nominee nom-inee In Nevada and J H McMillen was the Republican nominee The former was elected by a plurality of twenty four or at least that was the number which showed on the face of the returns re-turns He was inaugurated and within forty test days Mr McMillen filed his con testHe first alleged that there were distinguishing dis-tinguishing marks upon the ballots for Governor Sadler in every county of the state and a sufficient number of ballots bal-lots with these marks to overcome the plurality of his opponents But several sev-eral demurrers to this sweeping complaint com-plaint were sustained by the supreme court until there were left but five counties over which the contest must be decided Of these District Attorney Attor-ney F R McNamee of Lincoln county who is also here estimated the total vote as follows Lincoln from 700 to 800 Elko 1100 White Pine 0 Lander Lan-der GoO and Eureka 500 making about 3130 out of a total stole vote of 11000 from which the contest must be settled All of the votes of these counties will be presented to the supreme court to be canvassed and the county clerks are wending their way to the state capital ital with the ballot boxes In their care Should the court find that there an more than twentyfour votes for Sadler with distinguishing marks they will be thrown out and his plurality overcome The bright legal lights of Nevada are engaged In the case Governor Sadler has General Clark Thomas Wren and exCongressman Woodburn while Mr McMillen has A E Cheney Trenmore Coffin and several other attorneys Tht case will be presented to the court in as able a manner as has been heard in any court of the state |
