Show I BRIG SPENCERS CASE It I Doing Zae No God I Garfield lI County Complaint reaches The Herald from I Garfield county concerning the acton of the Republican board of pardons in the case of Brigham Spencer who is I serving a term in the penitentiary for i stealing a steer and the acton of the I board In declining to grant a pardon is said to I in the face of the evidence s be helping the candidacy of Judge Zane not a bit down in that localty In the year 1896 BrIgham Spencer was indicted with George Davis and Jacob Reese charged with stealing a steer Both Davis and Reese were excon victs having served a term in the I Utah penitentiary I was shown at the trial by Davis who turned states I evidence Reese having jumped his bonds that the extent of the offending of Snencer was the nointng out of several stray cattle to the other two who took them Spencer was convicted and in December De-cember sentenced to one year in the penitentiary After his sentence and incarceration his friends began working in his behalf be-half I was discovered that to all intents in-tents and purposes Spencer was the victim of the other two and that he was an innocent man Among the affidavits af-fidavits on file is one from Mrs Phoebe P Blackburn wife of the man who I owned the steer to the effect that the animal he was convicted of taking was never stolen at all and that her husband I hus-band disposed of the same to Edward Wilcox Co of Escalante lIr Blackburn I Black-burn makes affidavit to the effect that he sold the same steer to Wilcox B L Blackburn states that he saw the I animal and that Spencer did not steal it itThe I The petition asking for the pardon I sets up all the facts here related and In addition there is a petition asking for the pardon signed by John Foy Chidester formerly state senator and prosecuting attorney the county clerk the postmaster a justice of the peace the county treasurer jury commissioner commission-er the sheriff and deputes and many good and influential citizens I Is represented that the conviction is a mistake and the signatures of the jury to that effect are also In evidence Spencer Is a hardworking industrious ous man who hitherto bore a good reputation In the face of the fact that the steer was not stolen and was sold by its owner afterwards this man is compelled to languish in prison Indignation In-dignation is said to be running high down in Pangitch and locality and the mented action upon of the board is freely cern |
