Show lTWO HIrnDRED THOTISAND D F Walkers Suit Against the I Gas Consolidation SOLD THE OGDEN PLANT He Alleges That 200000 Is Due in the Transfer Ho Wants JTliat Money and a Restraining Order Against the Consolidated Company Com-pany A Tax Deed Decision District Court Orders David F Walker filed an attachment suit against J Elliot Condict in the Third district court yesterday The plaintiff alleges that on February 8 1893 he entered into a contract with the defendant de-fendant to sell him the stock of the Ogden Gas Light Fuel company and that on April 1 1893 there was due the said plaintiff the sum of dO000 and also 60090 of the first mortgage bonds of thE Salt Lake and Ogden Gas Electric company com-pany it is also alleged that there is an additional flOO000 due on June 1 and the plaintiff prays for judgment in the total sum of 200000 A companion suit was also filed by David F Walker against J Elliot Con diet the Salt Lake Ogden Electric Light company the Salt Lake Ogden Gas and Electric Light company of New Jersey the Gas Water and General Investment In-vestment Trust limited of London England and P L Williams The plaintiff prays that pending a hearing the Salt Lake Ogden Gas Electric Light company of New Jersey be restrained re-strained from voting by any of its officers and agents or by proxy any of the capital stock of the said Salt Lake Ogden Og-den Gas Electric Light company now owned by jt to authorize the increase of the issue of the first mortgage bonds of the Salt Lake Ogden Gas Electric Light company beyond 1000000 now authorized and from delivering a proxy for such purpose also to prevent it from assigning or transferring the capital stock of the said Salt Lake Ogen Gas Eelectric Light company owned and held by it and that P L Williams be restrained re-strained from voting the capital stock of the Salt Lake Ogden Gas Electric Light company owned and held by the New Jersey company for the purpose of authorizing an increase of the issue of fir t mortgage bonds thereof that the Salt Lake Ogden Gas Electric Light company be restrained from entering a transfer of the capital stock now owned by the New Jersey company or in anyway any-way aiding or assisting the latter in making mak-ing such transfer The plaintiff also prays that J Elliot Condict be adjudged indebted to him in the sum of 200000 560000 of which is I due in first mortgage bonds of the Salt Lake Ogden Gas Electric Light company com-pany and that upon a hearing the said I last named company be directed to pay him the said sum |
