Show THE MiNER LAW The Supreme Coait Affirm the Decision of the Lower Court WASHINGTON Oct 11Tbe United States supreme court by Chief Justice Fuller today reaffirmed the judgment of the Michigan supreme court upholding the constitutionality of the famous Miner law providing for the choice of presidential presi-dential electors by congressional districts instead of by the state as a whole The court holds that tho fourteenth amendment to the constitution of the United States did not limit the right of each state to fix the mode of choosing electors It is conceded con-ceded that the effect of the decision is to give part nt least of the Michigan electoral vote to Cleveland The opinion unanimous unanim-ous Chief Justice Fuller in announcing the conclusion of the court said tho announcement announce-ment made at this time because of the exigency ex-igency suggested by counsel requiring early action Ho eatGr the court would file an opinion setting forth more fully the grounds on which it decided the caso on the question of jurisdiction which point tho Democrats waived The chief justice said the court ruled that under section 700 of the revised statutes stat-utes it had jurisdiction The chief justice said further the court ruled in view of language in the clauses of the constitution giving to the state legislatures the right to de mine the method of choosing presidential electors and contemporaneous statute it cannot be herd invalid for want of power in the state legislature to pass such a law adding that tho clause of the first section of article U of the constition was not changed by tho fourteenth amendment ana the law was cot obnoxious to that amendment |
