Show DISTRICT COURT A Suit for Fatal Injuries Death of a Dancing Dan-cing Master In the First aistrict court yesterday forenoon i fore-noon was occupied in the trial of the case of Peter ° Stubbs vS E H Parsons and Clark Eldredgo Li Co Testimony was taken at considerable length showing life course taken by Dunn Co in their assignment as-signment tho value of their goods and the steps taken by the defendants in taking the property under their execution A nonsuit was granted by Judge Blackburn Black-burn on motion of Mr Sutherland From the testimony it appeared that Clark Eld redge Si Co had never subscribed to the agreement made by the other creditors to accept a pro rata as the business allowed while being carried on under the assignment assign-ment This will give Clark Eldredge Co the right to dispose of the goods under the execution L LLL JDO next case to DO triea was mat 01 Mary E Scofiold vs Payson City King Houtz and Georgo Sutherland are attorneys at-torneys for the plaintiff and Arthur Brown and J B Milner for the corporation corpora-tion Suit is brought by the plaintiff who is administrator of tho estate of John W Scofield for 20000 damages because of negligence in allowing an excavation to remain re-main open on the public square On the 4th of November 1891 Mr Scofield ned dently drove over the cave and received fatal injuries death ensuing three days afterwards Several witnesses testified to the size of the excavation the date of Mr Scofields accident and other facts connected con-nected with the case A DEAD DANCING MASTER A H Tappan the old dancing master is dead He breathed his last at his boarding board-ing place Mr Knowels residence at 4 oclock yesterday afternoon Dr Shores who attended him thinks ho had cancer of the stomach The deceased for the past four years has been engaged in teaching dancing in this vicinity and a deep sympathy sym-pathy is felt at his demise although his existence ex-istence for more than a year past has not been a very happy one It is thought he has a daughter in Mississippi and also other relatives Almost a fortune has been spent by the deceased in the Louisiana lottery lot-tery It is thought he has a life insurance but very little else to call his own Ho will be buried by tha Masonic order of WhICh he was once a member A short time before be-fore his death Mr Tappan requested of the writer that the band play Sweet Dreamy Faces at his funeral AN OLD MAN LOSES HIS LEG William Hawley ustico of the peace at Oasis was brought to Provo yesterday afflicted with a running sore on his right foot Drs Pike und Shores examined the affected member and decided that it would have to bo amputated The operation was performed at 4 oclock and up to the present pres-ent time he is doing as well as could bo expected although thoro are great fears of his being unable to recover as he is old and very weak Assistance was given in the amputation by Henry Hawley his son and S M Duggins at whose residence the work was done MISCELLANEOUS Prof Carl Hill gives bis concert tonight at the Firemans ball The same was published pub-lished in Tim HEItALD a few days ago Thoro will be a horse show today a parade being made through the principal streets of the city beginning at Lewis livery liv-ery stable Blooded horsos will be brought from all portions of the county to participate partici-pate in the procession Prof Hills class will pivo their exhibition exhibi-tion tonight at the firemens hall Tho horse parade will start from Lewis livery stable at 2 oclock and parade the principal streets Thoroughbreds will bo I seen which have been hrniifrht in from dif ferent parts of the county Wednesday evening May 4 is the time set for the meeting of tho Democrats of Provo precinct at which ten delegates will be elected to the county convention and an orgrnization effected A subscription is being taken up for the burial of Prof Tappan who will be interred inter-red Sunday at 10 oclock Jerry Reese of fayson formerly of Great Britain was admitted to citizenship Sixty days was granted in the case of Jungk and Fabinn vs D C Reed et al in which to prepare statement for a new trial |
