leave to report We have received four distinct propositions prop-ositions covering the amount named in the resolution copies of which proposl tons are hereto attiched After careful care-ful personal examination of these propositions we consider proposition No1 by L D Kinney very mudh the most desirable The 100 lots in Kinneys subdivision No 1 are well located are near the copper works are of excellent soil well watered and cultivated and are immediately imme-diately available as desirable homes for copper plant employees Block No1 of this proposition No1 containing some 10 acres adjoins the main copper plant works immediately on the north and lies within one block of the present and prospective business i center tha may be expected to grow up with the copper plant development I We are therefore of the opinion that said proposition No 1 covers fully thc spirit and intent of the aforesaid resolution res-olution and therefore recommend its aceptance THE COPPER PLANT We also examined the works being erected by the copper plant company t The works are larger than proposed by j the company are being built in a most permanent and substantial manner and I are being rapidly pushed to completion The present estimated output of the I plant In copper silver and gold is H 000000 per annum We are assured that the raw ores for this output are already in sight The substantial permanent and complete com-plete character of the works and the amount of money being expended upon them is an assurance to us that the projectors themselves believed they were right In above streets submitted a joint report recommending that the two street railway companies be granted the fifty year franchise instead of twentyfive years The committees reported re-ported they had examined the subject carefully and found that in most of the large cities in this country the franchise to street railway companies are either perpetual or for long tferms of years Therefore the city would be doing nothing unusual in granting the i long term The committee had made some important changes in the franchises fran-chises among them being a provision for uniform passenger transportation so that the suburban residents may bo I able to reach the business portion of1 f the city cheaply and a provision to allow the council and board of public works to provide for the protection Oil citizens and property from danger from the use of electricity The statute regarding re-garding paving Is copied The report was adequate and the franchises were laid over to come up under the head I of SEWER I The committee on sewerage and committee com-mittee on public works reported that i it would cost 267210 to complete the gravity sewer to State and Fifth South streets including farm and An net was passed by the last session ol the legislative assembly of the territory of Utah entitled An act to appoint ap-point a Board of Police and Fire Commissioners Commis-sioners In certain cities and to place the police and fire departments upon a nonpartisan non-partisan basis and Whereas Section 8 of said act reads as follows Sec 5 > The board hereby created creat-ed shall supervise and control said fire and police departments its officers members and employees subject to the ordinances I of the respective cities and laws or this territory and shall see that the officers members and employees thereof faithfully discharge their duties and that the laws orders and regulations relating thereto are earned into operation and effect and Whereas I has come to the knowledge of this council that the mayor and chief of police of this city did on the Sth day of April 1S9J without consulting with or authority from said commission authorize autorze instruct anti command thirty police offi > ers of this city to proceed to the city of Ogden and that said thirty police officers did I in obedience to said authority instrucclons and command absent themselves from their postaof duty as such police officers in this Pity and that by reason of said action on the part of the mayor and chief of police this city was left with a greatly decreased police protection at a time and under provides as follows SeE 4 The police department of cities of 12000 or more inhabitants of this territory shall consist of a board hereby created a chief and a captain of police and such other officers and men a the city council of said cities shall direct therefore be i Resolved First that Mayor R N Bas lila and Chief of Police Arthur Pratt by so authorizing directing and commanding said police officers to leave their posts of duty in this city acted inadvisedly arbitrarily i arbi-trarily and without authority of law thereby usurping the power expressly conferred con-ferred by section 8 of the aforesaid statute upon the Board of Police and Fire Commission Com-mission Second that the Board of Police and Fire Commissioners of this city are here by requested to thoroughly investigate the power of the mayor and chief of police to so control the police department of this city and alto their power to impose upon this city the expense of affording police protection t other cities in this East South Temple street repaired ana placed in proper condition at once Rejected TH STREET RAILWAY EXTENSION EXTEN-SION The ordinance granting the City Railway Rail-way company a franchise for fifty instead in-stead of twentyfive years was taken up and read Remington said he wanted the matter mat-ter laid over for one week until the company would give the city security for the payment of the amount already paid out by the city for paving between be-tween the tracks of the road He presented pre-sented a resolution t that effect but as Cohn and other members of the committee felt assured that this would be arranged before the ordinance was signed by the mayor this was loot on a close vote The franchise was then passed by an unanimous vote FIVE CENT FARES I provides that there San be no more than 5 cents charged for fares within the city limits as they now are or hereafter may be extended S TAXES Instead of time tax of 114 mills on every fare collected it is provided that the company shall pay 25 per car every year for the average number of cars operated in addition to the regu lar taxes PAVING In relation to paving it is provided that said company shall be required to pave or repave at its own expense and cost all space between its different rails or tracks and also a space two feet wide on the outside of the rails of the outside tracks and the tracks herein referred to shall Include not only the main tracks but also the side tracks crossings and turnouts used by said company Such paving or re paving by the said railroad company shall be at the same time and shall be of the same material and character as are proper for the repaving of the streets or alleys on which said railroad rail-road track or tracks are paved and located unless other material be specially spe-cially ordered by the board of public works Provided that where the said company has double tracks on the same street and It be required for the accommodation ac-commodation of some other corporation corpora-tion or person to lay its tracks a greater distance apart than it would be required to do but for the accommodation accom-modation of such other corporation or person then in that event the said railroad company shall not he liable for or required to pave said additional distance RAPID TRANSIT EXTENSION The ordinance granting the fifty year franchise to the Rapid Transit was taken up This Is identical with the previous one except that the company com-pany will be allowed to charge more than 5 cents on the military reservation reserva-tion The franchise was passed unanimously unani-mously Remington presented tho following resolution Resolved That his honor the mayor be and is hereby requested to not affix his signature approving this the city railway ordinance
