from tho committee on live stock reported on H F 10 the live stock bill concerning the branding and herding of cattle recommending that the bill bo I placed upon its passage as amended The amendment makes it unlawful for any person IL per-son to load in the night time cattle etc for shipment and also prohibits any railway company from furnishingany car for such purpose The amendment was adopted J placed upon its passage Adopted THE BUREAU JOF STATISTICS Also on the creation of a bureau of stat istics witDout recommendation and offer ing a bill covering the governors ideas on the subject Adopted SUBSTITUTE RAILWAY BILL Mr Hammond reported on H F 9 and L H F 52 relating to railroads offering a substitute therefor The substitute was adopted The substitute requires railway companies to fence their lines so as to pre vent the killing or injuring of live stock Tne substitute was adopted TBOM TIlE JUDICIARY COMMITTEE Mr Thurman from the judiciary committee com-mittee reported favorably on H F CO a bill in relation to probate procedure recommending re-commending that it bo placed upon its passage pas-sage sageAlso on H F 01 in relation to the estab lishment of division fences with the same recommendation Adopted On H F 62 a bill creating public administrators ad-ministrators and defining their duties with amendments and recommending that it be passed as amended The amendments make the county treasurers exofficio pub lic administrators Mr Allen objected He thought the governor gov-ernor had the right to make these appointments appoint-ments but he had no objection to these officers being appointed by the county court but he was opposed to whipping the devil around the stump in this manner It did not necessarily follow that because a man was elected county treasurer be would be a fit man for public administrators Ho was downed by the opposition however and tho amendments were adopted On H F 63 the bill requiring notaries public to affix to their signatures the date of the expiration of their commissions recommending its adoption Adopted FROM THE COUNCIL The Council announced that it had passed C F 35 a bill providing for the incorporation in-corporation of cities Referred That it had amended C F5 relating to persons becoming a body corporate to raise funds to be loaned only among tho persons of such association in accordance with the recommendations of the governor and as amended had passed the same Re x ferred That it had passed C F 40 making sheep stealing grand larceny Referred I That it had passed C F 41 providing for the custody of commissioners records x etc Referred MUST GIVE DUPLICATE RECEIPTS Mr Howell introduced H F 67a bill compelling the territorial treasurer to give duplicate receipts for all moneys received one to the person paying the money and one to the auditor of public accounts Re ferred THE ARTESIAN WATER BILL H F 32 Williams bill to prevent the waste of artesian water came up as special order Mr Russell offered an amendment which provided that in case it is shown that the stopping of the water was likely to cut off the entire flow of any particular well the owner thereof may claim exemp tion from the provisions of the act Mr Porter was in favor of the amendment amend-ment Mr Kimball was opposed to the amendment amend-ment and in fact was forninst the whole bill It was without the power of the legislature to pass nay such a law Mr Porter had been at one time in favor of the bill but he was now opposed to it because his constituents did not want it passed Mr Bennion thought his constituents wanted such a measure enacted The amendment was adopted Mr Kimball wanted to strike out tho enacting clause Mr Creer submitted a letter from Lehi to the effect that in all cases where the wells were closed during the winter months they yielded larger flows in the spring Mr Thurman objected to the killing of the bill It was one that should be passed Prom the data that he had he had reason to believe that no valid objections could be urged agsinst the passage of the bill Mr Kimball bucked again We were dealing with private property and theater w the-ater brought to the surface belonged to the man who had expended his money to get it there Mr Porter onnosed the motion to strike out outMr Mr Pierce thought there was nothing in the point made by tho gentleman from Weber and he was opposed to the striking out outThe The motion to strike out was lost and the bill passedayes 16 nays 5 FROM THE COUNCIL The Council communicated the fact that i i t had passed C F 31 a bill concerning cities of the first and second class Re I ferred C F 25 the bill authorizing the estates of decedents and minors to be mortgaged in certain cases as amended then passed the House TilE CONFERENCE COMMITTEE The report of the conference committee on C P 37 giving justices courts jurisdic tion in cases of forcible entry and detainer was adopted by the House and the bill then passedayes 20 noes 2 THE SUGAR BOUNTY BILL H F 21 the bill to provide for the encouragement en-couragement of the manufacture of sugar and paying a bounty therefor then came up on special order and was slightly amended Mr Porter made a strong argument in favor of the bill which he thought should be passed The prospects were very good that the sugar plant would be put in and when once in operation it would secure to the territory over one million dollars yearly Mr Allen was not opposed to the bill but he was going to vote against it because he did not know whether there was enough money in the territorial treasury to take care of the public institutions now on hand Mr Williams spoke in favor of the bill Mr Thurman was of a similar frame of mind Wo had reached a point in our his tory when we are able to extend help to such worthy institutions It is only jus tice to encourage the expenditure of 300 000 to the small extent this bill proposes to do This appropriation should be made If any curtailing must be done let it bo done in other directions It has been demonstrated dem-onstrated that sugar can be made and we should give the projectors all the encouragement encour-agement possible The bill was then passed Wood Allen Sargent Pierce and Kimball voting in the negative It is as follows Section IBe it enacted by the governor and Legislative Assembly of the territory of Utah That there shall be paid out of tho territorial treasury to auy corporation firm or person engaged in the manufacture of sugar in this territory exclusively from beets sorghum or other sugaryielding canes or plants grown in Utah bounty of 1 cent per pound upon each and every pound of sugar so manufactured during the years 1S90 and 1891 under the conditions and re strictions of this act Sec 2No bounty shall be paid upon sugar not containing at least ninety 90 per cent of chrystalized sugar The quan tity and quality of sugar upon which bounty is claimed shall be determined by the secretary of the territory with whom all claimants shall from time to time file verified statements showing the quantity and quality of sugar manufac tured by them and upon which such bounty is claimed Upon receipt of said statements the secretary shall without unnecessary delay visit or cause to be visited by suck person as he shall desig flare in writing the factory where said sugar has been produced or manufactured and take such evidence by the sworn tes timony of the officers employees of such factory or others as to amount of and quality of so sugar manufactured as u > him or tho person so designated by him shall appear satisfactory and conclusive The sugar so manufactured shall be placed by the manufacturer in original packages which shall be examined and branded by the said secretary or person by him desig nated with a suitable brand showing tho quantity and quality of sugar contained in each of said several packages an ac t I curate account of which shall be filed and kept in the office of said secretary Sec 3The compensation or fee for said services shall i not exceed five rents per package nor So per day for each days service said fee or compensation and the necessapy travelingexpenses of said person inspectingand I the cost of said brand and any and all analysis that the said secretary or other authorized persons shall require to bo made shall be borne and paid by claimant for said bounty Sec 4 When any claim arising under this act is filed verified and approved by the secretary the territory as herein provided pro-vided he shall certify the same to the territorial ter-ritorial auditor who shall draw a warrant upon the treasurer of tho territory for the amount due thereon payable to the party or parties < to whom tho said sums are due Sec 5That the sum of S20000 or so much thereof as may be necessary is hereby appropriated to pay said bounty for the years 1890 and 1891 provided that the amount drawn shall not exceed 10000 the first year Sec 6No bounty shall be paid unless a plant capable of providing at least fifteen tons per day and cjstingat least 200000 shall be established THE RAILWAY RIGHTOFWAY BILL KILLED H F45 the railway rightofway bill came up as special order and the enacting clause was stricken out THE LIVE STOCK BILL REPASSED H P 10 the bill in relation to the brand ing and herding of cattle was repassed as amended DESTRUCTION OF ANIMALS AND BIRDS C F 3
