Show Ben jaminnFranklius Heirs Sue ii PHILADELPHIA Sept 29In the orphans court today a petition was filed by the I heirs of Benjamin Franklin praying that the 100000 now held by the Board ojf City o Trusts and known as the Franklin und be turned over to them alleging tHat the provisions of his will are in violation of the rule of perpetuities in common law Un der his will probated in 1790 Franldin bequeathed be-queathed in trust t Philadelphia and Bos ton each 1000 sterling to be invested in loans at 5 per cent interest to married young cent to assist establishing them in business Ho had in view the accumulation of a large fund for the purpose specified at the expir ation of one hundred years the remainder to be reinvested for one hundred years The first period having elapsed the Phila delphia fuiid has reached 6100000 and the Boston nearly 400000 The suit will be decided here before action is taken at Bos vicinity ton There are about fifty heirs in this |
