Show Ii THE MONTANA STEAL 1 t i A Debate in the House on How the Republicans Did it EDMUNDS ANN TRUST BILL Its Provisions in Detail Tliey are Stringent and the Penalties Imposed are Very Extreme A 1VASHIiGTOi April 2Edmunds from the judiciary committee reported back the antitrust bill in the form of a substitute und said that as soon as the Montana election i elec-tion case was disposed of the bill would betaken be-taken up The conference report on the urgent deficiency de-ficiency bill was presented and agreed to The House recedes from its disagreement to the Senate amendment as to the irrigation irriga-tion surveys with a proviso that no part of the amount be expended in sinking wells or the construction of irrigation works and that the government shall be not committed com-mitted to any plan of irrigation The Senate then proceeded to the consideration consid-eration of the Montana election case the majority report being in favor of Wilbur i Sanders and Thomas C Power the minority A mi-nority report in favor of William A Clark and Martin Maginnls Hoar stated the case on the part of the majority of the committee the whole matter mat-ter turning upon the question whether one set of delegates whovotedwith the twenty live Republican delegates for Sanders and Power were legally elected from the county of Silver Bow or whether the other set who voted with the twentyfour Democrats for Clark andMaginnis were legally elected deputies Gray representing the minority of the committee made a statement in support in support of the claim that Clark and Maginnis were entitled to scats He commented com-mented upon the finding of the canvassing board of Montana which declares that no abstract the votes had been received from Silver Bow county that they had exhausted the authority given to them by statute endeavoring to obtain it and that it therefore became their duty to assert 4 as-sert and declare it from the best sources of information obtainable and he argued tJlat the canvassers had no authority tot to-t on any information obtained from any source other than the election officer of the county declaring that he had never known such a bold and fragrant usurpation und the members cf the canvassing board Df Montana the governor chief justice and the secretary of the territory should have been whipped at the jail in every county and town in the territory GeorgeIs there any evidence of the record that the legislature of which this Iron hall house the Republican house claimed be part ever performed any legislature act or passed any law GrayNone whatever The governor never recognized this Iron hall house but recognized the house which met at the court housethe Democratic houseas the lawful and rightful house Teller interrupted Gray to say that various A va-rious communications had passed between the Iron hall house and the senate Hoar There is no other lawful evidence of the title of the governor or any other state officer of Montana except this very canvass which the Senator from Delaware says has no validity whatever Gray then went on to denounce the indecent in-decent haste with which the territorial canvassing board made its report and adjourned I ad-journed with full knowledge of the fact that a court of competent jurisdiction had issued a peremptory mandamus ordering an abstract of the votes in Silver Bow county to be made out and furnished the members that the territorial canvassing board stands convicted of participation In that sharp practice in which the majority of the committee on privileges and elections would have the Senate also become a participator Gray went on to speak of the evidences of haste with which thePresidents proclamation for the admission admis-sion of Montana had been issued He did not accuse the President of being a participator partici-pator in the conspiracy but he alleged that the President had been persuaded by the conspirators to make himself an instrument in consummating their designs < Tile minority committee he said accepted the findings of the county board of Silver Bow county and they held the lawful credentials cre-dentials Gray yielded the floor without concluding his argument and the death of Representative Represen-tative Wilber being announced the Senate adjourned |
