Show TUB MUST FLASH F1JAIIa A Little Spat Over the Injunction In-junction Case IT WILL COME UP TODAY Jesse CummIngs is Granted a Peculiar Divorce The Duckworth Damage Case Flynn Goes up Today Tho case of W L Pickard vs Salt Lake city in which the plaintiff seeks to enjoin the city from entering into any contract with 1 H Bacon for the sale of the Old Fort square to him came up before Judge Anderson yesterday morning Frank Hoffman who appeared for the plaintiff stated that the hearing on the order to show cause was originally set for Monday morning but on Saturday Judge Powers who represented the defendant obtained an order continuing it until Tues day morning He had received no notice of this and was ready to proceed with the hearing Mr Hoffman stated that P L Williams would appear with him for the plaintiff Mr Williams said he bad been spoken to by a number of citizens who wished to join Mr Pickard in regard to I appearing for them If the hearing was continued at all he would ask that it be continued several days Judge Powers was sent for and he stated that Mr Dickson would appear with him for the defendant He was willing that the matter should bo continued until this morning and the hearing definitely set then There would be no necessity for a temporary restraining order pending the hearing as the contract would not be exe cuted until after tho matter had been de cided The case was then continued until this morning JL DIVORCE GRAFTED The divorce case of Jessie Cummings vs Alva Cummings was then taken up Mrs Cummings testified that she was married to the defendant in this city in 18f4 Her husband failed to provide for her and the care of herself and family devolved upon herself Some years ago she left the de fondant and since then he had done nothing towards her support The decree of di vorce was granted A SHEEP CASE ju cuu case ux Alex va Adamson VB Frank Rudy the demurrer was sustained The plaintiff in this action alleged that in 18S9 the defendant called on him and stated that somo of his sheep had strayed in plaintiffs herd Tho latter told him to go and get them and in a short time Rudy returned with three sheep tied down in his wagon and asked plaintiff to como out and examine them The plaintiff did so and then in the presence of bystanders Rudy falsely ac cused the plaintiff of stealing his sheep and putting his own marks on them He de manded twentysix sheep and threatened that unless they wore immediately delivered to him ho would inform the neighborhood that thcplaintiff been stealing his sheep By these threats the defendant induced plaintiff to deliver to him the twentysix sheep The plaintiff sued for the value of the sheep 78 and f 1000 1 damages The de murrer was sustained because the com plaint failed to set forth the libelous language lan-guage used by the defendant THB DUCKWORTH DAMAGE CASE The case of Joseph Duckworth vs Sail Lake City Railway company was passed until Wednesday PASSED FOR THE TERM The case of R D Winters vs E T Ayer was passed for the term FfcTXN TO BE SENTENCED TODAY In the case of J D Flynn who was re cently convi ted of grand larceny the mo tion for a new trial was overruled and sen tence set for tomorrow morning OTHER BUSINESS In the case of Harriet T Drake vs Rachel Reggie et al the demurrer of Wil liam Palmer was withdrawn The case of C J Erickson vs E T Ayers was continued Emma Morris vs W S McCornick same order W H Casady vs J F Marks same order Ephraim Johnson vs Swen W Loven dahl same order In the case of Kate W Jackson vs George Jackscn the defendant failed to appear and a decree of divorce was granted |
