Show IN ALL THE COURTS The Salt lake Rock Company Up For Contempt THE BOTHWELL INUNCTION CASE A Brief Days Session In the Police Court Business Before Judge Bartch Yesterday An order has been issued citing the othcers employees etc of the Salt Lake Rock company com-pany to appear before Judge Zane on Saturday next and show cause why they should not be punished for contempt The names of the de lendants are John W Young president of the company Daniel Harrington secretary John Doe Hamilton manager J Nelson L Stone J E Garsett F Dunlady F Scott R Cook Olive Johnson Tom Johnson H Olson C H Jacobs E Bradford AV Locke T W Bell AV Fulcher L Mayberg J Hamilton R Hamilton O K Dunbar J AV Young S Johnson J Cs sidy Green 1 MeNd contractors John Jones Evan Jones Evan W Jones Albert Swope Wm J Sherwood John D Reese Doc Wil hams A Addle and John Doe Keenan The history of the case is as follows On the 20th of November last a suit was entered against the Salt Lake Rock companv by the United States at the instance of the officers ut Fort Douglas the reasons therefor being a claim that the rock company wad befouling ihe waters of Red Butte canon creek the source of water supply for the fort Upon this the Third district court issued an injunction restraining the rock company or its agents from in any way or manner fouling and polluting the waters of Ked Butte cailon creek or permitting any refuse offal excrement manure or other dele terious matters from reaching the waters of said stream by seepage drainage or otherwise or from watering horses or other stock there from The company was further ordered to desist from maintaining its camp of men and animals near the creek Yesterday Mr Varian as attorney for the plaintiff filed an affidavit settirig forth that the rock company the defendants in the action had been served with the notice of injunction and goes on to say that he is officially informed by the commanding officer of Fort Douglas and therefore states upon his information and belief that on the 30th of November ISbS and con tinuously thereafter till the present date the rock coujpiiuy its agents find employes have wilfully and couluinituou1y < liobt > yeU the writ of injunction by foul ug the waters of too creel and oy refusing to uesist twin permitting any refuse or inuiuie from reaching the water or mum allowing their MUCK tii be waered from the creek The affidavit further States that the excrement from sud men and animals is ifposited about sixty feet from said stream and will ultimately find its wa into the waters thereof and in such quan titles as to be a most fruitful source of disease and probable death among the officers and men of the garrison at Fort Douglas That the rock company is now running two tunnels near the crest of a hill above said stream and give out and threaten that when said tunnels are completed com-pleted which affiant is informed an t believes will be within ten days next ensuing it will explode ex-plode the same with a large quantity of gunpow den or other high explosive material and that such explosion will in all probability throw hundreds of tons of roct into the bed of said 1 stream in such manner as to divert the water 5 thereof from their original channel and cause them to seep through in iheir flow towards the military reservation all sorts of manure and dirt The Third District The Bothwell injunction ra ° e drags its length slowly aloog before Juage Anderson It is quite probable Mr Jams will take the stand when court opens this morning Oocock J twill probably take at least two days more time n which to produce evidence and argue Ihe case F Before Judge Zane the case of Thomas B Clark et al vs Ann Clark et aL was argued and submitted Before Judge Pyper In the police court yesterday Thomas Flan nagan James Corcoran and Con Haffay were each fined 15 WIll Colbert and Oscar Everett the two lads who were up yesterday for housebreaking are bfith held to await the act ion of the grand jury Will was left in care of his father without bail Oscar cave bail In the bum of 5200 C W AVallace for keeping a gambling den w as lined 75 Alvin Duval doorkeeper for Wallace was fined S23 James M Perkins and Thomas Faltoa for gamb ing were fined 150 each In the Probate Court Judge Bartch transacted the followingbusi ness on Tuesday Estate of Joseph Brown Proof of publication made case taken under advisement astopeti ion for final settlement and distribution to again be heard on the 20th inst Estate of Nathaniel Taysum Proof having been made that B G Taysum had complied with the law In nil other particulars and had flied his final account the court made a decree finally l discharging tho said administrator |
