Show Colorado Sues Her ExState Treasurers DENVEU Jan 7The attorneygeneral yesterday afternoon on behalf of the state began suits against exState Treasurers Treas-urers Nathan S Culver William C Sanders San-ders Fred Valsen George R Swallow and Peter W Breen together with their bondsmen for the purpose of recovering the money which it is alleged these officials dais received as interest on state funds loaned to different banks and for which they failed to account to the state The amount sued for is not stated in ttie complaint com-plaint but it is believed the amount so received re-ceived by each treasurer during the two years term will reach nearly mm hundred thousand dollars The suits are brought loran lor-an accounting and brings up the question whether or not the state bus a right to di maud a return of interest upon state lunu held by them during their incumbency of office The principal point involved in the controversy is whether the state treasurer is merely a custodian for the state or whether being absolutely liable for T being lable any and all losses of state moneys entrusted to him he becomes virtual owner of the money t do with it as he sees fit until called upon to expend it for state purposes or to turn it over t his successor at the expiration of his term of office |
