somewhat larger than common Mr I Saxey tor the defense argued a motion for a new trial on grounds of having proceeded winder a wrong section of the statutes Ii King for the territory maintained that the suit was brought uncer two sections The motion of the defense was overruled and I Duggins was called up for sentence The judge in pronouncing the same stated he I had been informed that a similar case had formerly been brought against the prisoner which would influence a stronger sentence on this one The crme was regarded by the judge as as very dangerous to the wel fare of young men and corrupting to all classes The sentence of the court was that defendant pay a tine of SCO and costs of prosecution besides being confined in the county jail for a term of one month Mr Saxey asked that a bond be allowd the defendant for a stay of judgment inS in-S both line and imprisonment pending appeal and ten days be allowed on which to give notice A bond of 400 was required in Question of fine
