18S9 Special Correspondence of THE Hen ILT > j The < constitutional i convention has adjourned nearly all the members have lei t us and our little city has resumed its wonted quiet The Republicans have gained some political advantages but not near as much as vo supposed they would have done Besides disfranchising the Mormons they have adopted the same tactics in the apportionment apportion-ment article of the constitution which gives them an advantage of at least OOJ in the representation of their party in the legislature If the plan of the Dubois ring had prevailed we should have had a legislature legis-lature and state officers elected this fall at the time of the submission of the constitution constitu-tion It vas their intention to go to the people representing that if a Democratic state ticket and legislature was elected jho work of the convention WOULD UB OF tfO AVAIL and Idaho be kept out of the union I It was presumed that the people vould not notice the unpatriotic mean and detestable principle involved in this case but would voto in such manner man-ner as would quickest conduce to bringing about statehood It was avowed by Willis Sweet in a speech in the convention when iho schedule was under consideration that such was a part of tho plan When the morals of a political party get at so low an ebb it is time for its existence to cease Mr Clagett of Shoshone county was opposed op-posed to tho scheme perhaps not because of its unfairness and illegality ille-gality but he was against Dubois and in favor pf Clagett for United States Senator Ho needed time to set up his pins and make ready for the contest Ho s not very well acquainted in southern Idaho and it will require another year to make him a formidable competitor of the young man from Illinois The north has two other candidates for the same position one is W B Hezburn a railroad attorney of Shoshone and the other W J McConnell McCon-nell a money loaner of Latah The prominent prom-inent candidates in the Democratic party are J W Reid of Nez Perce A II M y hew of Shoshone Albert Hagan of Kto tenai and George Ainslie of Boise The Democrats think they can carry the territory terri-tory if a proper canvass is made and your correspondent is quite hopeful in the premises TUE PRlXCIlAL IOIXTS The following are the principal points in the constitution as adopted by the convention conven-tion The preamble declares that tho people peo-ple of Idaho are grateful to Almighty God for their freedom which we really hope is the truth Article 1 Section 1 tells us that all men are born free and equa f and in the next section ccomes the declaration that all political po-litical power is inherent in the people which would undoubtedly be true if the people would avail themnelves of such right and exercise their power in a proper manner Section 4 disfranchises Mormons and all jthers whom it may please the legislature to disfranchise The construction of ditches flumes pipes railroads tunnels etc is declared to bo a public use and private property may be taken therefor after appraisal and payment for the same The legislative department is invested with the usual powers embodied in constitutions consti-tutions and provides that the house of representatives rep-resentatives shall never exceed sixty in number and the senate twentyfour Each county shall have one member of the lower house Sessions to be held biennially Avery A-very few cases are enumerated where the legislature may pass special laws County heats can only be changed by a two thirds rote of tho people and county lines only on he vote of the people of the territory to be detached and annexed No act takes effect in less than sixty days unless it contains emergency clause The executive department consists of governor secretary of state state auditor state treasurer attorneygeneral and superintendent su-perintendent of public instruction They hold their offices for the term of Ere years The governor may approve part of an appropriation bill and disapprovf of the balance He gets 3 000 per year secretary of state 51600 auditor lbOO treasurer SlOOO at torneygeneral 3000 and superintendent of public instruction 1500 The judiciary report creates supremo court of three members and a district court of five Each of the judges receive 3000 per annum The supreme holds four terms of court per year two at Lewiston and two at Boise City Tho legislature have the right to establish other courts District Dis-trict attorneys receive 2500 per year and I hold their respective positions four years I Article 0 guarantees an absolutely secret ballot Mormons are disfranchised and I women con vote and hold school offices The legislature is empowered to use its in what I discretion in all cases defining shall constitute the qualifications of a I voter The fiscal year should commence on the I second Monday of January of each year Duplicate taxation on tho same property is prohibited Taxation on real and personal property shall not exceed ten mills on each dollar until the assessed valuation shall exceed 30000000 ttf graduates sob the amount of property increases treasurer constitute a board of equalization Counties arc enjoined to do business on a ash basis and may levy a tax for a sinking fund and buy in their own warrants at a discount i The legislature shall not in any manner create liabilities exclusive of the debt of the territory at the time of its admission of more than ono and a half per centum on tho assessed value of property within its limits unless a submission be made to the people and their consent be obtained nor shall the credit of the state be loaned to any Individual association or municipality Tho school fund is declared to be inviolate in-violate and intact and nothing but the interest in-terest thereof shall be made use of for any purpose The state treasurer is to be casto lan of the fund No school lands shall be sold for less than ten dollars per acre and not more than twentyfive sections sec-tions shall bo sold in each year Compulsory Com-pulsory education is provided for The scat of government and penitentiary are located at Boise City for twenty years tho insane asylum at Blackfoot and the university uni-versity at Moscow All towns and cities must incorporate under a general law no special charters are to be granted Railroads declared to be public highways and subject to legislative I legis-lative control No foreign corporation to do business in the state without having an I r authorized agent in the same upon whom process may be served The legislature can pass no law concerning railroads retroactive retro-active in operation 1 The state shall never assume the debt of any county town or otner municipal corporation cor-poration and no county town or public corporation shall loan its credit to any person per-son company or association i A bureau of emigration and labor is established es-tablished under charge of a commission f who shall be appointed by the governor by t and with tho consent of the senate He holds his office two years and until his successor suc-cessor shall havc been chosen and qualified Eight hours are declared to be a days 1 work on all state and municipal works and 1 all persons not citizens of tho United States i i are forbidden to be employed on state or municipal work Liens are provided for in cases of labor demands Tho militia article provides for tho enrollment j I t en-rollment and equipment of all persons be ttveen the ages of eighteen and forty fire I c and forbids any flag emblem to be carried except that of tho state or nation il fa fo Appropriations of waters are declared to be a public use and the right to divert them from any stream secured In the use of water where the supply is insufficient domestic do-mestic uses rank first agricultural next and manufacturing third In mining districts however the rule favors milling and raining rain-ing Any proposition to amend the constitution constitu-tion must be agreed to by twothirds of each branch of the legislature and then submitted sub-mitted to the people The senate is made to consist of eighteen members and the house thirty six The election for ratification or rejection of the constitution to take place on the first Tuesday Tues-day after the first Monday in November Immediately upon the admission of the territory ter-ritory as a state the governor of the territory terri-tory shall issue a proclamation calling an election for state and county officers which should not be less than forty days after the time of the issuance of tho proclamation The instrument is very long thu largest constitution wo have ever seen There is too much in it the proper subject for statutory law This morning Secretary Reed figured up the expenses attending holding of the convention and it footed up between twentynine and thirty thousand dollars It is a very expensive production when its quality is considered There area are-a great many elements of weakness in it and it will not receive the majority many of its friends anticipate Fourteen thousand dollars are about to be
